The libel started in June last year, when the Channel 5 released the “Stop Corruption: “NIBULON’s Credit Secrets” program and later on a number of similar programs caused a massive public outcry over this false information. During several years, NIBULON publicly denied the biased news containing false unchecked selective information with untrue facts and suppositions, blackmail and lie. The false statements against NIBULON alleged that it had privatized a part of the port and the shipyard, has numerous facilities in offshore zones and elevators abroad, reduces grain purchase prices on the Ukrainian grain market, implements grain export schemes enabling the company to hide real income and move it out abroad, and sells grain in offshore areas. The company allegedly does not manage to financially fulfill obligations before the European Bank for Reconstruction and Development, evades port and river dues, prevents the legislative regulation of cargo transportation by water transport, including by the Ukrainian rivers. Foreign mass-media, in particular The New York Times newspaper, published news about alleging NIBULON’s dishonesty in doing business, inability to make statements, evasion of journalists from the Stop Corruption TV Information Agency Ltd, and habitation in Switzerland.We would like to mention that most mass-media refused to publish this false and untrue information, recognizing its openly biased content. Mykolaiv Nikvesti website was one of those mass-media that published this information, despite the company’s detailed denial posted on NIBULON’s official website.In order to protect the company’s good business standing, NIBULON applied to court. It was not so easy to fight with the so-called “anti-corruption persons”. The Stop Corruption TV Information Agency Ltd tried to avoid responsibility in court and denied (!!!) posting any false facts about NIBULON which could damage its business standing. According to the Stop Corruption TV Information Agency Ltd, it does not have any information specified in the statement of claim, and it has nothing to do with the facts spread in “NIBULON’s Credit Secrets”. Can you imagine this? It is very cynically!!!       Thus, the Stop Corruption TV Information Agency Ltd tried to avoid objective accusations of false negative information about NIBULON, thereby testifying that the Stop Corruption TV Information Agency Ltd refuses its “NIBULON’s Credit Secrets” video. In addition, the representatives did not attend any court session. At the beginning, we did not manage to find employees from the Stop Corruption TV Information Agency Ltd at the judicial address in order to give them lawyer requests. It looks like the information agency is a phantom one.While denying its words in court, the Stop Corruption TV Information Agency Ltd continued its dirty media war, terrorizing NIBULON’s management and employees. They threw mud at NIBULON and then denied everything. In September 2018, the representatives from the Stop Corruption TV Information Agency Ltd made several provocative actions at NIBULON’s Lidiivske branch (Mykolaiv). Thus, NIBULON’s employees had to apply to the law-enforcement authorities. On October 16, 2018, another slanderous article named “Removing Competitors and Bribing Judges: NIBULON’s New Corrupt Story” was published on the Stopcor website. In this article, the Stop Corruption TV illegally disclosed information subject to pre-trial investigation secrecy and therefore committed a criminal offence. On October 17, 2018, the Prosecutor General’s Office was notified of a criminal offence (in accordance with the Article 214 of the Criminal Procedure Code of Ukraine) and was requested to start a pre-trial investigation of the criminal proceedings.NIBULON proved its rightness in the first instance court (the Economic Court in Mykolaiv region decision dated 05.06.2019). The information spread in the “NIBULON’s Credit Secrets” video by the Stop Corruption TV Information Agency Ltd was declared as false and negative, harming NIBULON’s good business standing. Nikvesti Production was obliged to deny this information on the NikVesti official website (http://nikvesti.com/) within three days of the court decision coming into force.We did not stop there and proved the absolute correctness of NIBULON’s claims in the second instance court. The Southwest Economic Court of Appeal completely confirmed NIBULON’s claims (court decision dated 06.09.2019). In compliance with the court decision, the information spread in the “NIBULON’s Credit Secrets” video on June 2018 and published in the “Channel 5 showed how NIBULON benefited from credit schemes” web-based media was acknowledged as false and untrue, harming NIBULON’s business standing.  The Stop Corruption TV Information agency Ltd and Nikvesti Production were prohibited to spread this information.In accordance with the legislation, the Stop Corruption TV Information Agency Ltd and Nikvesti Production, had they attended court during the case investigation,  might have deleted all the false and untrue information from its internet resources (the court decision dated 07.09.2019). In addition, Nikvesti Production might have published a denial not later than September 09, 2019. Both the Stop Corruption TV Information Agency Ltd and Nikvesti Production were absent during court sessions.Nikvesti Production received a copy of the decision made by the Court of Appeal on September 16, 2019. Thus, the decision needed to be implemented no later than September 19, 2019. Nikvesti Production did not implement the decision of the Southwest Economic Court of Appeal dated 06.09.2019.In its turn, the Stop Сorruption TV Information Agency Ltd does not receive a copy of the decision (dated 06.09.2019) sent by the Southwest Economic Court of Appeal on September 12, 2019. Please note that this information is available on the official judicial authority web portal, i.e. the Stop Corruption TV could have carried out all the required measures to implement the court decision.  This testifies that the Stop Сorruption TV Information Agency Ltd is ignoring correspondence connected with NIBULON in order to avoid the responsibility for spreading false negative information about NIBULON.The Stopcor information portal and the Stop Corruption TV Information Agency did not respond to NIBULON’s proposition to find foreign real estate, planes, yachts belonging to the Vadaturskyys in exchange for the offer to spend time there. So, please find the courage to admit that you consciously spread biased and false information about our company.It is not for the first time when the heads from the certain Ministry (which have been promoted recently) order this information to prevent the company’s development. We are speaking about the former – current employee of the Ministry of Infrastructure who was the first to share this biased information about NIBULON on her Facebook page.We do hope that those who plan to persecute NIBULON’s transparent and responsible business by using a journalistic mask will think about reasonableness of their actions. The blatant illegal actions by pseudo-journalists cannot remain unpunished, as the permissiveness leads to new illegal methods of such pseudo-mass-media.  We are convinced that these people do not have any moral right to call themselves journalists.By the way, Stop Corruption has been expelled from the Global Investigative Journalism Network (GIJN) due to incompetence and conflict of interest. This is the first case of a member being expelled in the history of the network, which has 177 member organizations in 76 countries!NIBULON acts within the current legislation. Despite this biased information, the company continues working with its foreign and Ukrainian partners. NIBULON enjoys the confidence of foreign financial institutions, which has been formed during many years. Consequently, these mean attempts to attack the company using disinformation will not be able to destroy NIBULON’s good business standing. We ask all mass-media not to publish the false information about NIBULON created by the Stop Corruption. Do not forget that a journalist is a vocation rather than a shady bargain and fraud. We ask you to contact NIBULON’s press center when publishing any information about NIBULON. We will quickly answer your questions, and you will avoid court proceedings because of fake information.It is not the end of this story… Our company continues searching for the guilty (we know who they are) in order to make them responsible. This is NIBULON’s obligation to the partners, such as first-class world banks, investors, and others worldwide. Confidence and good business standing are vitally important for the company. We will continue fighting against any false information about NIBULON. This is our working style for 28 years.
