Although the facts in these articles are invention, and the topics of “future accusatory” articles are known, as they have been repeatedly used by our opponents in a dirty struggle against us.
For example, the last fake article is based on invented theses of the information war against NIBULON in 2009-2011, when the management of Mykolaiv Commercial Sea Port and the Ministry of Transport and Communications of Ukraine illegally blocked the Preventer vessel, not letting to call to the berth of our facility. Hennadii Zadyrko, a former people’s deputy, was a temporary information voice of the port. Based on these statements about the alleged non-payment of taxes and their minimization, use of offshore zone, price cutting and so on  a letter with a forged signature of the first deputy head of SE “Delta-pilot” Mykola Shchurikov was sent to the PM of Ukraine. At the same time, Hennadii Zadyrko sent similar deputies’ appeals with his signature and signature of his supporters (other people’s deputies) to the Presidential Administration of Ukraine. Consequently, the facts presented in these letters were inspected by the Security Service of Ukraine, the Prosecutor General of Ukraine, authorities of internal affairs of Ukraine, customs authorities, and by Specialized State Tax Inspection for Work with Large Taxpayers in Mykolaiv. The facts mentioned in deputies’ appeal, including tax evasion by NIBULON weren’t confirmed by the results of thorough inspection.

This will be enough for one more fake article, so we ask respectable media to be critical about such kind of information and, if necessary, we will provide the supporting documents. Today we will add some explanations. 
To have competitive advantages over transnational companies which open representation offices in Ukraine and are already funded due to loans of the first-class western banks, we are compelled to look for cheaper credit resources. To this end, having an individual license of the National Bank of Ukraine to invest abroad, we established our subsidiary in the Netherlands in 2004 and in 2 years – in Switzerland.  We have never had intentions to conceal the existence of the subsidiaries. They operate officially and within the legislation; therefore, their names – Nibulon Trading B.V. and Nibulon S.A – are close to the Ukrainian company. Economic activity of these foreign companies is under close and constant supervision of international audit companies of the countries where they are located.
As individuals, neither Oleksiy nor Andriy Vadaturskyy is a founder of the Swiss or Dutch company. However, according to the constituent documents they had the authority to sign any documents as the companies’ representatives.  Thus, signature of NIBULON’s General Director Oleksiy Vadaturskyy on the documents of NIBULON Group is not a surprise; according to the constituent documents his signature is a signature of the authorized representative of the legal entity, therefore, it is in all signature cards and is recognized by both foreign and Ukrainian banks and their representative offices that provide services to 45 branches of the company. Immediately after Andriy Vadaturskyy became a people’s deputy in the Verkhovna Rada in 2004, he transferred his share to Oleksiy Vadaturskyy (in full) in the authorized capital of the company to run this share. Since then his signature was excluded from the register of foreign and Ukrainian banks.
The authors of fake information are trying to mislead the readers saying that our company purchases commodities in Ukraine at alleged low price and sell it at inflated price abroad (the statements are denied by numerous inspections). This is the height of incompetence on the grain market circulation. The thing is that grain market is highly competitive and the price is formed on market price in foreign markets. Moreover, prices are being published on the official website of the company for 13 years and everyone has free access to this information.
Since 2013 NIBULON annually reports to the State Fiscal Service on controlled transactions of Nibulon Trading B.V. and Nibulon S.A. The level of profitability of controlled transactions is within the market profitability interval; it is confirmed by reports of the international audit companies. This means that prices for commodities in the transactions between NIBULON and Nibulon Trading B.V. and Nibulon S.A. are not lower than the market ones. Thus, we can state the NIBULON’s tax liabilities within given transactions haven’t been reduced; our company pays taxes at the rate prescribed by the law. Our company paid more than UAH 947 million of taxes and charges over the last three years. If relevant regulatory authorities have questions, we are always ready to give explanation as we run our business transparently and within the legislation.
From time to time in our company, as well in other companies, there are personnel changes.  There is nothing unusual or illegal. Personnel changes occur in planning mode. Financial institutions are informed about such events in advance.
We emphasize once again, one cannot stop us! Knowing Ukrainian realities, our foreign partners realize that a series of fake articles has nothing to do with the real things. Thus, this situation only strengthens our position. However, we reserve the right to go to court to defend our business reputation, if the media continue to publish fake information.
