NIBULON has been shipping for export Ukrainian grain and handling hundreds of motor vessels (they supply grain to 64 countries around the world) on its own berth for more than 12 years.
Tens of specialists from different departments both from NIBULON and state structures are involved in the export activity. The process is perfectly arranged. Certainly, contingencies sometimes happen, but when an official, using his authority, tries to hide his mistakes by doing other actions, the price of mistakes is high.
Jin Qi motor vessel (registered in Honkong) to be loaded with 66 thousand tons of barley on NIBULON’s berth experienced such a situation on July 14, 2015.
Everything went according to schedule, until inspectors from the State Ecological Inspection of the Black Sea North-West Region decided to use unchecked information on water surface pollution by oil products from Jin Qi. In order to demonstrate their “rightness”, this information was published on one of the Internet sources.
NIBULON’s specialists have responded to it immediately, as environmental safety of the estuary as well as the city is of prior importance for NIBULON.
That day, NIBULON’s certified laboratory carried out visual and chemical water researches in the estuary water area. They disproved water pollution facts.
Deputy head of Mykolayiv Sea Port Yuriy Onopko also disproved this fact. He said that the port captain had not received any official documents (as to pollution) from the ecologists.
Instead of admitting their mistake, the inspectors kept proving their “rightness”.
As a result, an investigation department of Mykolayiv Municipal Government of the Department of the Ministry of Internal Affairs of Ukraine in Mykolayiv region started a proceeding No.42015150010000062 dated 16.07.2015 in order to check speculation (!) based on false information spread by the inspectors. This caused a great amount of investigatory actions.
Thus, tens of officials had to be distracted from their work, and namely NIBULON’s General Director and his three deputies, transshipment terminal’s director, head of legal department, deputy head of environmental protection department, specialists of foreign economic relations and marketing department, laboratory technician, specialist of labour protection department, prosecutor from Mykolayiv Public Prosecutor’s Office and investigator from Mykolayiv Municipal Government of the Department of the Ministry of Internal Affairs of Ukraine in Mykolayiv region, representative from agency company, surveyor, plus three inspectors of the State Environmental Service.
Let alone a number of other specialists from the customs and border service of Ukraine. They promptly had to issue a permit to cross the state border so that law-enforcement authorities and regulatory agencies might come on board the vessel, inspect its deck and engine room in the course of pre-trial examination.
Taking into consideration that the vessel was loaded completely in the outer roads of Mykolayiv Sea Port, NIBULON had to involve its tug, which transported grain along the Dnipro, in taking the investigator, prosecutor and inspectors on aboard the vessel to do investigatory actions. This cost more than USD 4 thousand without taking into account losses caused by cargo trip disruption in order to take the investigator on board the vessel.
According to the results in the course of pre-trial investigation, the investigator did not find any signs of oil or lubricant spill and made an appropriate record on board the foreign vessel. Concerning waste ballast deficiency that was specified in the inspection statement, it is within the limits of error. When heeled by 2.5 degrees, the waste ballast should be measured according to the relevant tables. The specialists from the environmental inspection did not prove their competence and did not use these tables, thereby causing data falsification. This resulted in the pre-trial investigation performed by the internal affairs authority.
But the inspectors kept acting.
On completing cargo operations on board the vessel, NIBULON provided all documents to the inspector. The inspection body did not make up an environmental declaration within the time specified in the legislation. As a result, both the vessel and the cargo had to stay for 9 (!) hours in the roads.
The vessel managed to leave the port only at 17:25, on July 21.

At first sight, everything seems fine. Pollution is absent. The company performed the foreign economic contract. You may say it is their duty to check. But it is not all that simple.
The officials who were involved in could be of use to any of us instead of disproving speculation. NIBULON’s General Director could invest money in the company’s development, create new workplaces or could allocate funds for charitable projects.
The prosecutor and investigator could investigate a real case, unmask a criminal and prevent a dangerous crime. The inspectors from the environmental inspection could detect and check real pollution in the local rivers.
And tax payers could see their taxes are used as intended.
This event can hardly add positive image to Ukraine in the international arena.
