Recently a number of web-based media have posted an article entitled “”Black Grain” is Illegally Exported through the Elevators of Kernel and NIBULON”.
It is said in the article that “(…) The investigation revealed that Ukrainian Grain Trading Company PP purchases agricultural products for cash without registering any tax and accounting documents. After that, the company exports agricultural products to Uzbekistan and the Baltic states.
(…) The products are exported mainly through the elevators owned by Kernel Trade Ltd., Ukrainian Grain Ltd, and NIBULON Ltd., and the money is transferred to the accounts of business entities which bear the signs of fictitious ones in order to convert the money into cash”, state the documents of criminal proceeding (…)”.
Readers expect that there will be a continuation of a “sensational” story, facts, conclusions, etc., as it happens in professional journalism. But an anonymous author completed his article. There are several reasons for this.
First of all, the criminal proceeding, the anonymous author referred to and which was started in 2015, was closed in 2015 in connection with the absence of the criminal offence in the actions of S. V. Verenkiotov (director of Ukrainian Grain Trading Company PC) (Resolution on the closure of criminal proceeding of 05.11.2015). Consequently, the investigation did not provide evidences of any violations in the actions of NIBULON Ltd.
Unfortunately, the companies operating in Ukraine know the cases when the criminal cases are initiated for fictitious reasons. Thus, dishonest employees of the state bodies try to use their official status for self-enrichment. And we are pleased to note that there are many companies that honestly defend their rights and prove their innocence by legal methods. Unfortunately, such a situation happened to this company.
Secondly, according to the results of third party audit carried out by the General Directorate of the State Fiscal Service in Poltava region regarding economic relations of Ukrainian Grain Trading Company PC and NIBULON Ltd., the economic relations, their type, volume, quality and payments have been proved by documents. The audit also showed the business transactions and payments of Ukrainian Grain Trading Company PC and NIBULON Ltd. are reflected in the tax accounting. So, tax officers did not find violations of tax legislation or any other legislation.
Tax specialists are aware of the way our company conducts its business activities and how we struggle against the shadow schemes in the grain market. If a company bears signs of a risky business, we stop cooperating with it. Participants of the grain market know about such our approaches.
We would like to add that every year our company reduces the number of intermediaries, giving preference to cooperation directly with agricultural product producers (share of agricultural producers is 75 %). And our highly qualified employees know each contractor.
Thirdly, in the process of customs clearance of NIBULON’s export operations, the SFC authorities also have never found violations of legislation.
By the way, we haven’t had export operations with companies from Uzbekistan or the Baltic states for more than 20 years.
Fourthly, we actively and successfully cooperate with leading international financial institutions and appreciate their trust. The emergence of such situations means both reputational risks and potential losses for the company. Therefore, we simply do not have the right to let such things happen. And we don’t let them happen.
Therefore, it can be assumed that the employees of Comments.ua, which is the primary source of the article, submitted incomplete and one-sided information without verification and clarification of the facts, having violated the principles of ethical journalism. It is worth mentioning that this is not the first time the editorial staff of this resource is biased against our company by posting false information.
Transparent and honest way to conduct business, our struggle against shadow grain market and other activities aimed at defending the state position, as a rule, are the reasons for fake articles about us. The purpose of such articles is obvious – to vilify both our company and a people’s deputy Andriy Vadaturskyy.
Unfortunately, the cases of false information distribution in the media have become more frequent lately. We call on readers to treat the information more critically and the mass media to check the facts before publishing them. We are always ready to provide information about the company. If the mass media publish false information about the company, we reserve our right to apply to the court in order to protect the honour, dignity and business reputation.
