The election campaign to the Verkhovna Rada of Ukraine officially began several weeks ago. And Andriy Vadaturskyy also registered as a candidate for the People’s Deputies of the Verkhovna Rada. So a “pocket” editorial team of NikVesti immediately began its dirty information war against unwelcome people for its owners. It is known from open sources that the ultimate beneficial owner is Oksana Yanishevska, who belongs to the influence group of the former head of Mykolaiv Regional State Administration Vadym Merikov (“People’s Front”) and was appointed deputy head of the Regional State Administration during his chairmanship.
Apparently, NikVesti decided that “it’s time” to get out irrelevant information of the drawer and to publish a “scathing” article “Vice Governor Viacheslav Bon illegally sold NIBULON a land plot under the terminal in Voznesensk”.
It is a question of materials checking the status of executive discipline in Mykolaiv Regional State Administration, during which there were revealed violations of the sale of the land plot for the construction of NIBULON’s terminal in Voznesensk district. Attention, please. The inspection took place in November 2018. You need to have inhuman endurance in order to wait for 7 months to “disclose” these materials.
You can say that they were looking for evidence or verifying the information. Don’t even dream. That’s not about this editorial team. They only dreamed about journalistic ethics. At the beginning of spring 2019, Mykolaiv Regional State Administration submitted a report on the work carried out to eliminate violations and drawbacks found out during the inspection. In particular, it was noted that the issue of the land plot and the availability of documentation on land management regarding the coastal protection zone of the Southern Buh River was studied with the main department of the State Land Cadastre in Mykolaiv region. No violations were found. But whoever is interested in it, the customer demands negative information about the Vadaturskyys.
Unfortunately, it has already become a tradition for the employees of NikVesti to present false, fake, one-sided or insufficiently investigated information about NIBULON and its owners.
By the way, on June 5, 2019, the Economic Court of Mykolaiv Region recognized the information spread on June 10, 2018 on the website of Nikvesti under the heading “Channel 5 showed how Vadaturskyy earns on credit schemes” to be false, negative and harming the business reputation of NIBULON. The court also ordered NikVesti to publish a refutation about spread of negative and false information. Representatives of NikVesti didn’t appear at any court hearing. And all correspondence sent to the editorial office returned due to expiration of the storage period at the post office.
Today we will prove that the land plot for the construction of the transshipment terminal of NIBULON’s “Voznesens’ka” branch was purchased in accordance with the requirements of the legislation. It could not have been in any other way.
This story began long before today and until the appointment of Viacheslav Bon as deputy head of Mykolaiv Regional State Administration or acting head. The issue of the restoration of cargo transportation along the Southern Buh River has been escalating for a long time. Every year our city and region, being port and transit city and region, suffered a lot from traffic load on the roads. But everyone only complained about this problem or accused agrarians of breaking the roads. And nobody dared to solve it. Only our company developed a large-scale investment project on the revival of Ukrainian rivers as the main transport arteries of Ukraine. It attracted investments of the world’s leading financial institution and started its implementation.
Within this investment program, in 2016, NIBULON built its transshipment terminal on the Southern Buh River in Buzke village (Voznesensk district). As you know, we build our facilities in three months, but it takes us years to obtain permits. This object was not an exception.
In summer 2010, by order of Mykolaiv Regional State Administration No. 214-r dated July 8, 2010, we were given a permit to develop a land management project on the lease of a land plot of 5,3030 ha of pastures (for 49 years) for the construction and maintenance of transport infrastructure facilities connected with sea and river cargo turnover (of the transshipment terminal) from state-owned land not provided for ownership or use within the territory of Voznesensk district (Mykolaiv region).
Then a land management project was developed. It passed the state land management expertise of the Main Department of the State Land Committee in Mykolaiv region. The project was also approved by the then leadership of Mykolaiv Regional State Administration.
“The land plot with an area of 5,3030 ha, refers to agricultural land; type of land – pastures”. It is indicated in the certificate No. 2231-1900pl/7-714/10 dated July 16, 2010 on the quantitative and qualitative characteristics of the land plot provided by the Main Department of the State Committee for Land Resources in Mykolaiv region.
The fact that the land plot of 5,3030 ha belongs to agricultural land (pasture) and there are no restrictions on its use, is confirmed by the conclusion No. 1 dated July 15, 2010 (in accordance with Article 186-1 of the Land Code of Ukraine as in force at the time of allotment of the plot). The commission for consideration of issues related to the approval of documentation on land management, composed of officials of the State Land Committee in Voznesensk district (Mykolaiv region), the district architect of Voznesensk District State Adminsitration, the State Department of Environmental Protection in Mykolaiv region, Voznesensk District Sanitary and Epidemiological Station, the Department of Culture of Mykolaiv Regional State Administration approved the project of land management.
According to the conclusion of the State Department of Environmental Protection in Mykolaiv region, the land plot of 5,3030 ha is located not in the coastal protection zone, but in the water protection area of the Southern Buh River. This fact is confirmed by the technical documentation for the establishment of the water protection area and the coastal band of the Southern Buh River in the territory of the land use of Voznesensk district (Mykolaiv region) developed by Mykolaiv branch of the Institute UkrNDIzmeproekt, where the area of 5,3030 ha doesn’t belong to the costal band (Decision of the Executive Committee of Voznesensk District Council of People’s Deputies No.125 dated June 29, 1990).
On August 17, 2010, public hearings were held in Buzke village (Voznesensk district). The appropriate announcements were made in the media, and anyone could participate in these discussions.
In September 2010, (long before the appointment of Viacheslav Bon), Mykolaiv Regional State Administration and NIBULON signed a corresponding lease agreement (for a term of 49 years).
By the way, all these 5 years we were receiving 47 different permits to perform dredging on the Southern Buh River. The depth available at that time did not correspond to the theoretical depth; and they didn’t allow us to carry either cargo or passenger transportation
Upon construction and commissioning of the transshipment terminal in October 2016, we submitted a request for the purchase of this plot to Mykolaiv Regional State Administration. We received a permit to conduct an expert monetary valuation. On June 9, 2017, YUHZEMSERVICE Ltd. prepared a report on the expert monetary assessment of the plot according to the order of Mykolaiv Regional State Administration.
In accordance with the requirements of the legislation, an order No. 143-r dated April 26, 2018 was adopted by head of Mykolaiv Regional State Administration for the sale of the state-owned land plot of 5,3030 ha (cadastral number 4822080800:18:000:0153) to NIBULON.
According to the extract from the State Land Cadastre about the land plot with an area of 5,3030 ha (cadastral number 4822080800:18:000:0153), no restrictions on the use of the land plot are registered. The proposals of the Main Department of the State Geocadastre in Mykolaiv region according to the results of consideration NIBULON’s application for the sale of the land plot also lack information on the location of the land plot within the coastal protection zone and the restrictions on its use.
During the allotment of the land plot and construction of the transshipment terminal, no issues were raised by law enforcement agencies and state control bodies.
Do not forget about the money, which the local budget received from NIBULON for the lease and purchase of the land over the years (more than UAH 4 million).
As of today, the site is in excellent sanitary condition, and coastal protection has been carried out. No damage was done to the local community or the ecology of the river and settlements.
Thus, the information that the above-mentioned land plot is in the coastal zone and was acquired in violation of the requirements of the legislation is not true.
We call on Oksana Yanishevska and Vadym Merikov to be first and foremost decent and to stop discrediting NIBULON and its owners using NickVesti. You destroy not the best investment climate of Mykolaiv region, as you haven’t achieved much after being in power. It is a pity that young workers of NikVesti have only a great desire to help Mykolaiv and the region, but in reality they are engaged in low-grade propaganda and distribution of false materials. Remember that you are journalists, not executors of your masters’ desires.
