Business activity is always a risk. NIBULON’s employees think that it is possible to minimize such a risk when working within the legal framework.
“Modern society lives in time of difficult legal regulation”, noted NIBULON’s Deputy General Director on Economic and Legal Issues Andriy Vasylev, “The development of economic relations is not always accompanied by creation of legal norms. Consequently, a lawyer’s knowledge and way of thinking, including the possibility to solve different tasks fully, are of use to any person”.
Andriy Vasylev has legal and economic education. NIBULON provided him with the opportunity for self-realization both as a specialist in accounting and audit and a specialist in legal issues. He has been working for the company for 15 years. He built his career step by step working as an accountant of one of NIBULON’s branches in Mykolayiv region, then as a director of this branch, then he headed the department of planning and economic analysis. At present Andriy Vasylev is in charge of economic and legal issues of the company. He thinks that high level of responsibility and self-organization is a guarantee of professional advancement, self-improvement, high authority of a lawyer in the eyes of an employer, a principal or a client,
“An experienced lawyer, as a rule, acts in the name and for the benefit of other people. For example, a corporate lawyer acts in the name of a company, where he works; an attorney – for the benefit of a principal; a lawyer of a law firm – for the benefit of a client of such a company, etc. In other words, the fortunes of people and companies, as a rule, depend on accurate and timely actions of a lawyer”.
What does it mean in practice to be a lawyer? “Every day within the legal framework on the basis of practical experience you must solve legal issues that appear during the process of the company’s activity”, tells Tetyana Dmytrieva, a legal adviser, “The main duty of a lawyer is to protect rights and interests of a company from illegal actions of other persons and authorities”. According to Tetyana, the lawyers not only participate in law implementation, but also they contribute to the legislation development, improvement of legal regulation of social relations, strengthening of law, etc.
“I think that legal profession is unique as a lawyer must constantly improve his skills. We have the opportunity to influence on the events positively; thus, a lawyer is required to be responsible. Consequently, when working in NIBULON I am responsible for protecting rights and interests of our company”, adds Tetyana Dmytrieva.
An important quality characterizing a real expert is the ability to use different methods and ways of legal work taking into consideration constant legislation changes”, thinks Dmytro Glushko, a legal adviser of NIBULON’s legal department, “Depending on the sphere of professional activity, a lawyer must be familiar with different knowledge in jurisprudence as well as in other sectors. English knowledge is also important. All these things allow a lawyer to build effective tactics of his actions, to win cases and to protect rights and interests of a company or a person”.
According to his colleague Natalya Musiychuk, efficiency of the company’s work is always directly proportional to the level of legal culture of each employee, “Legal culture is, first of all, law knowledge to use laws in daily life, high level of respect to the law authority, as an important social value for normal functioning of a civilized community, atmosphere of law obedience, stable internal need to keep the law, social and legal activity”.
The legal department works in a constant dialogue with all NIBULON’s departments and employees. Head of the department Volodymyr Grinchenko thinks that such common and persistent work of all the departments can influence on creation of NIBULON’s positive image in cooperation with its partners and community, “I was always impressed by NIBULON’s intention to work accurately and in coordination, to make decisions efficiently and quickly”, notes the head of the department.
Today under the direction of Volodymyr Grinchenko there work 12 specialists in the law sector. “Efficiency of our work consists in devotion to the common cause that unite us in a friendly team”, says Oleksandr Slobodyanyk, a legal adviser.
His colleague Dmytro Golubenko tells that when he chose his future profession he did not hesitate even for a minute asking himself what profession to choose, “Long before finishing school I decided to get legal education and to become a lawyer. I think a lawyer is a person who respects rights and freedoms of others, provides help defending dignity and justice. Probably, this very aspect became a key one for me”.
“The lawyer’s advice or decision can influence on a lot of things. It is impossible to achieve successes without reasonable and deliberate attitude to your work”, thinks Dmytro Petrovskyy, a legal adviser.
“From the first day our company has been following the main rule: to work professionally, efficiently and within Ukraine’s legal framework. This very thing made NIBULON successful”, says Oleksandr Kravchenko, deputy head of the legal department, “It does not mean absence of many problem issues, but their positive solution is a matter of time. Abuse of legislation by dishonest economic players, presence of gaps and unconformity of the normative acts incite to constant protection of rights and interests of the company, monitoring, introduction of proposals and initiatives as to legislation that will contribute to further economy development”.
Valentyn Boyko, a head of the department of legal support in executive proceeding and bankruptcy procedure, stresses that among all companies NIBULON corresponds to the status of a company operating within the legal framework the most, “It is an original company that can strive for the best results”. This argument made Valentyn Boyko quit his job as a government employee and come to work for NIBULON in due time. The work of his department is connected with the execution of court decisions and also repayment of credit requirements in a bankruptcy procedure, “It is not so easy to work. Separate decisions cannot be performed even within a year. When working only within the legal framework, you can always receive just solution of the court”.
“Nowadays lawyers are in-demand”, thinks Valentyn Boyko, “It is a positive tendency, as a lawyer is a person who must know not only limited information; jurisprudence is a conscious choice to act within the law. I do not want to insist that a lawyer is an embodiment of justice; search for justice and its assertion is one of those directions where every lawyer works constantly. The more such lawyers will be in our society, the quicker our life quality will change”.
