In February 2020, the company’s specialists conducted an investigation of the material assets misuse and a theft attempt at Sukhorabivska branch. Upon completion of the investigation criminal proceedings were initiated, and the company fired Burian O.B. His actions caused NIBULON considerable losses and can cause losses in the future. The impudent and criminal misuse of duties and attempts to harm other employees in order to avoid responsibility testify that Burian O.B. lacks honesty, decency, and respect for others and for himself. The investigation initiated by NIBULON will be brought to the court to receive fair judgment. The crime must be punished.Probably, this very NIBULON’s management principal position made Burian O.B. seek a chance for revenge against his former employer. Having been fired, he tried to blackmail, sabotage and to spread false information in social networks.Burian O.B. decided then to join the Stopcor information portal and the Stopcor TV Information Agency Ltd, which are known for their cynical information war against NIBULON. By using all possible dirty methods, they have purposefully put pressure upon the company during six months. It took NIBULON more than a month to prove the illegality of these actions in court.This is just a further episode of the criminal actions by these pseudo-journalists. They also terrorized other companies.Stop Corruption has been expelled from the Global Investigative Journalism Network (GIJN) due to incompetence and conflict of interest. This is the first case of a member being expelled in the history of the network, which has 177 member organizations in 76 countries. Consequently, Stop Corruption activities are an outrageous blackmail and racket of the so-called “journalistic activity”. Thus, we consider these actions as an attempt to seek revenge for losing a court case concerning the spread of false information. Moreover, the pseudo-journalists use the same dishonest methods, namely untrue and unchecked selective information containing blackmail and lie. It concerns the “NIBULON was revealed to pollute rivers with toxic chemicals in Poltava region” article published on April 29, 2020. The above-mentioned publication is fake, untrue distortion of events, and another attempt to manipulate readers. We officially announce that all the company’s branches serve the community interests and operate within the legal framework. NIBULON preserves the environment and ensures the sanitary and epidemiological welfare of people. Firstly, the statement that our company “takes water directly from the Psel River without any permission” is absolutely false. Sukhorabivska branch conducts water intake from outside of Sukhorabivka village (Reshetylivka district, Poltava region) from the Psel River, a left-bank tributary of the Dnipro, based on the item 9 “Water users must conduct special water use given a special permit” of the Article 44 of the Water Code of Ukraine (further – WCU) based on a special water use permit No299/PL/49d-18 dated 11.10.2018 issued by the Sector of the State Water Resources Agency of Ukraine in Poltava region as required by the paragraph 2 of the Article 49 of WCU “A special water use permit is issued by the territorial bodies of the central executive authority which implements the state policy in the water development sector”. In general, this permit was given to NIBULON in order to conduct water use at all its facilities in Poltava region. The permit is valid until October 11, 2021. The right to use water is stated in the paragraph 1 of the Article 42 of WCU “Companies, organizations, Ukrainian citizens, foreigners and persons without citizenship, as well as foreign legal entities can be water users in Ukraine”. NIBULON’s branch takes water from the Psel River to serve its production needs (to prepare solutions to spay fields) rather than from the well based on the Article 61 of WCU “Underground drinking water must be used to satisfy drinkable needs and domestic water supply as well as food and farming industries”.Secondly, the manipulative statement that the tractors “move freely along the riverbank” is a weak attempt of the pseudo-journalists to add at least some information to the article. NIBULON’s tractors transport water from the established water intake point and in compliance with the established route. In order to minimise wear on the access road and water intake point, the company uses an MTZ tractor with a small volume tank installed on a trailer. The branch has a bigger 10 m3 tank, but it is used to receive water from a transporting tank and to deliver water for preparing solutions directly in the field. The company uses a mobile Honda motor pump to take water from the river, and the hosepipes do not have any contact with the solutions to spray fields. Thirdly, “the fields are sprayed with toxic chemicals” is false information. The company uses pesticides and agrochemicals that meet the state and sanitary standards, as well as other normative documents. Field spraying and water intake respectively are carried out at night in compliance with the item 6.1.5 “All the works with pesticides must be performed in the early morning (till 10:00 a.m.) and in the evening with a minimum rising air current. Fields may be sprayed in the daytime during cloudy and chilly days with an air temperature of not more than +10C” and the item 6.11.3 “the use of pesticides to protect plants is allowed only from 22:00 p.m. till 7:00 a.m.” of the State Sanitary Rules and Regulations 8.8..1.2.001-98 “Transportation, storage, and use of pesticides in the national economy” approved by the Resolution of the Chief State Sanitary Doctor of Ukraine, dated August 3, 1998 No.1.Fourthly, another manipulation “…close cooperation with the local authorities can be observed. For example, the village head’s declaration contains an income obtained from a property leased to NIBULON. In fact, the village head’s wife annually receives an income from NIBULON for leasing land plots to the company. The company assists her in tilling a land plot free of charge. Other villagers and our landlords receive the same services from NIBULON. These are normal business relations, and the attempts to demonize them demonstrate the biased information in the article. Fifthly, the police arriving at a place where NIBULON’s former employee organized provocative actions did not make any claims concerning the branch operation. The police did not register any violation of the quarantine or the water intake standards. All the required documents were present. In turn, an act for the prevention of NIBULON’s activities was drawn up. Probably, this idea was prompted to our former employee by the Stop Corruption portal which is experienced in arranging such provocative actions. Every villager (except those offended law breakers) remembers the destroyed farms, uncultivated fields, and rent payments in the form of agricultural commodities instead of money, which were current before before NIBULON constructed its branch in the village in 2006. Now Sukhorabivska branch, with its 15 year-old history, takes leading positions in production. The branch demonstrates a perfect working culture, green areas, as well as the company’s social responsibility. We constantly allocate funds to develop the Sukhorabivka local infrastructure to hold and organize holidays, to improve the health of schoolchildren, and to repair the village school. Thanks to NIBULON, pupils and teachers use modern technologies to make the educational process more interesting and efficient. The school now has a modern multimedia projector. The company allocated UAH 100,000 to provide high-speed internet in the village two years ago. At the end of 2019, the company allocated UAH 117,155 to finish the construction of the football ground in the village center and to purchase an artificial surface, gates, and fence. All the works will be completed after the quarantine has finished. Our company does not ignore the most urgent problem today – the COVID-19 pandemic. NIBULON gave 70 sets of medical protective equipment to the Central District Hospital of Reshetylivka District Council in Poltava region, 30 sets of medical protective equipment to the Center for Primary Healthcare of Reshetylivka District Council in Poltava region. The Kremenchutska Intensive Treatment Hospital received UAH 50 thousand from NIBULON to prevent the spread of COVID-19.It is obvious that the epidemic does not stop the pseudo-journalists from publishing false information. When all the leading journalists and community are on the frontline studying, analyzing and spreading the information on the pandemic, they try to blackmail and prevent from doing business, using their criminal information terrorism. Probably, they are not competent enought to do real journalism. It is very sad. NIBULON is preparing documents for a court and will obviously prove that its case is right.
