Harvesting at NIBULON’s “RE “Lidiyivs’ke” branch
 
Part I
Lidiyivka Fantasies of “Solidarity”
There is a peculiarity: if other “wars” against NIBULON headed by Hero of Ukraine Oleksiy Vadaturskyy can be called situational (the so-called demonstrative epic with Preventer); thus, the All-Ukrainian Public Organization “All-Ukrainian Labour Movement – Solidarity” (further as “Solidarity”) does not dissipate its talents. All their energy is directed to struggle with those who, according to them, “took away, usurped, seized” (it concerns Lidiyivka village of Domanivka district of Mykolayiv region). Though, several years ago, in 2010, one of the present “fighters for justice” Semen Lutsenko in the name of the so-called all-Ukrainian Public Organization “Cooperation and Success” (headed by V.O. Kobzar) incited Lidiyivka people to illegal strikes, having counted on consequences of 2005, when there were attempts to frustrate sowing campaign in RE “Lidiyivs’ke”. But he did not succeed.
However, Lutsenko’s plan was doomed to failure. Firstly, Lidiyivka citizens have realized their mistake, having weighed, on the one hand, their working places, deserved wage, NIBULON’s support in the social sphere of the village and, on the other hand, a demagogy in Ostap Bender’s style the villages are tired of. Secondly, cooperation (Lutsenko with Kobzar) was unsuccessful in the judicial way: judges of all instances considered Kobzar’s information as to NIBULON to be untrue and made head of “Cooperation and Success” pay moral losses.
The story repeats as farce when hammering away at the same point for a long time and without success. Lutsenko decided to search for success in “Solidarity”. And the organization itself with scanty size (primary organizations are only in Kyiv and Lidiyivka) and non-dimensional ambitions could not pass Semen Lutsenko in order to seek publicity on something “resonant” and at the same time to awake passive people – Lidiyivka citizens do not participate in strikes against “outrage of usurpers, invaders, thieves” etc. in the person of Oleksiy Vadaturskyy, NIBULON’s manager. People calmed down, as well as those who went to Kyiv city with anti-NIBULON posters painted at Chernomorskyy shipyard by order of the Churkins. People are just busy at the farm with highly productive foreign breeding herd and technical fleet equipped with foreign machinery mostly. This ensures high crop capacity and a considerable amount of money to the family budget. Taking into consideration social sphere infrastructure, renewed by NIBULON, it can be clear why there is no fire but smoldering of “people’s wrath” of Semen Lutsenko and his several like-minded persons including his own family.
 …The history of creation and development of RE “Lidiyivs’ke” branch  is well known. It was the first branch created at NIBULON; different periods of its development have passed, and today it is one of the best NIBULON’s branches. But there is “Solidarity” who has its website and every month publishes “unmasking” articles about the company. “Solidarity” has nothing new to say because of absence of new “facts”: an “agrarian baron” came to prosperous village, destroyed everything, deprived people of their right for land, and destroyed the leading and powerful collective farm “Lidiyivskyy” (Domanivka citizens know the situation). Probably, it would be necessary to argue the phrase “being in collusion with the district management, he took away land from villagers having deprived them and their succession of future. Public prosecutor’s offices of all levels, courts under all authorities (and this is important) considered NIBULON’s activity in the given village to be legal. And this is important fact taking into consideration that force authorities have terrorized the company with their inspections. These things are beyond understanding of Lutsenko, Viktor Nesterenko and other activists of “Solidarity”.
These are facts and history. In 1994 (NIBULON did not work there) at the general meeting Lidiyivka people decided to rename the collective farm ‘Lidiyivskyy” and to have collective land ownership. Land Privatization Project was approved by Sukhobalkivka village council. Later, villagers asked Oleksiy Vadaturskyy to include their farm in the company’s structure. An important moment is that Lidiyivka people were initiators, they addressed to NIBULON several times. This might have been the first step in the farm development for Oleksiy Vadaturskyy. Moreover, definitions such as “usurped land, land baron, feudal…” are ridiculous in this context.
Again, during the meeting people cancelled a decision to rename the farm, wrote an application to the village council in order to refuse collective land ownership, right to use land constantly and pleaded for providing NIBULON with a land plot to create branch in order to produce agricultural commodities. There were two agreements: the first one provides for transfer of basic assets and inventory holdings (for paying creditor debts of Lidiyivka farm) to NIBULON and the second one provides for transfer of fixed assets.
There is another circumstance that demonstrates groundless of “Solidarity” accusations. Before making these decisions, Lidiyivka villagers received detailed explanations about land legislation. General meeting of the collective farm “Lidiyivskyy” was held four times; specialists of the Regional Land Resources Management, lawyers, heads of the district explained the impossibility to get state land acts in case of entering NIBULON’s structure. Thus, people must decide reasonably and deliberately. In July 1996 NIBULON obtained an act of constant land use from reserve land (Lutsenko insisted that land was taken away from villagers) in accordance with the norm of the then version of the Land Code of Ukraine. And at the beginning of 2002 new Land Code entered into force according to which NIBULON leases 2,629 ha of agricultural land.
 Since then (since 1996) “broken over the knee” (according to “Solidarity”) Lidiyivka people feel quite well in NIBULON’s structure. At the meeting, on September 07, 2010, Lidiyivka people confirmed the rightness of their decision. And then they came to Kyiv city with an application “Lutsenko’s thought is not the community’s thought. For these years we have never been sorry for our decision to transfer land to NIBULON. The company has created almost 200 working places with deserved wage.”
 “Whom does this land belong to?  – To agrarian baron Vadaturskyy”, “public activists” have “creatively” changed actuality. “And only in 2003 – 2004, when the villagers started to strive for land right, Oleksiy Vadaturskyy returned land to the State Fund and reissued land lease right with the state and not with villagers”. What is the purpose of honestly stating the fact that NIBULON used reserve land in Lidiyivka village (at the general meeting the villagers voluntarily refused land right), and lease format was specified by the regulations of the new Land Code. Thus, according to the current legislation, the company has land relations only with the state. But here the idea of “accusing” articles destroys…
One of the subtitles of the “story” is the following: “Honour, dignity, business reputation”. But why are these words in quotes? They present these words in a scientific cover borrowed from sociologists. For example, “Business reputation of a person is a nonmaterial prosperity consisting in the estimation of a person’s activity in terms of his business qualities; in what way a person acts to achieve his aim”. It turns out that 43 branches of NIBULON in 12 regions of Ukraine, the unique export terminal in Mykolayiv city, more than 20 newly-built elevators and transshipment terminals, NIBULON’s fleet – the only one modern cargo fleet in Ukraine at present, construction of vessels at its own shipbuilding and repair yard “NIBULON”, Ukraine’s entering the first rank of world export leaders (also due to NIBULON) is not a result of business qualities of “grain speculator” and “agrarian baron”…Then what?
Probably, the “activists” of “Solidarity” think that such results are achieved in another way, known only to them. But the following question arises. Can the authoritative persons and institutions in the world be authoritative for the authors of “accusing” articles? These are the facts. Recently, the European Bank for Reconstruction and Development has allocated a loan of USD 130 million for NIBULON’s production activity. Nesterenko, Lutsenko and other “fighters” of the mentioned public organization should know that the EBRD gives loans only to companies carefully inspected. It is like a huge X-ray that “examines” all directions of the company’s activity, including interview with employees of some departments and services. And then the EBRD decides. It is a matter of trust. In 1998 (according to the same principle) the World Bank gave a loan of USD 5 million to NIBULON (for the first time to Ukrainian company). The largest financial institutions of Europe and the world, under the guarantees of the state governments, for example, Denmark, give loans to a “speculator who removes grain”, and they do not sorry for it. Is it better to rot residues at unequipped thrashing floors (as today Ukraine lacks of modern facilities to store grain)? It is uncomfortable to talk about such things, as all grain companies of the country compete for their place in the world grain market. In Ukraine NIBULON is a leader in this issue.
You should trust competence of President of the European Bank for Reconstruction and Development (the EBRD) Suma Chakrabarti, a person to whom NIBULON is neither kith nor kin but an entity of crediting, “NIBULON’s work experience and its unique investment project to develop infrastructure of Ukraine’s grain market and also to revive navigation on the Dnipro River and other rivers is very important to ensure food security in the region. The EBRD is very interested in expanding the best experience in doing business among its clients”.
Ambassador of Switzerland to Ukraine Christian Schoenenberger has the same opinion, “NIBULON’s activity is a model example of successful business that brings money, pays taxes and is engaged in long-term strategic projects”.
And this is a statement of EBRD’s Director for Agribusiness Gilles Mettetal, “We are negotiating with the company to credit another NIBULON’s infrastructure projects. We are proud of cooperating with such a company, one of the best companies in Ukraine”.
President of Ukrainian Agrarian Confederation Leonid Kozachenko, “Due to NIBULON’s participation in the UN food programs, every agrarian, delivering grain to NIBULON’s elevators, can be entity of global struggle with hunger”.
This information concerns reputation of the company and its constant manager Oleksiy Vadaturskyy which is prejudiced by Semen Lutsenko and its partners. Lidiyivka people cannot be deceived; they are aware of this issue.
And what is “Solidarity”? One should look through its website “Solidarity”. In the section “Contacts” there are only three contacts and two addresses. The all-Ukrainian Public Organization is in Kyiv city, 14 Kurchatova Str., room No.14; Kyiv local organization headed by Viktor Nesterenko is in the same room. Unfortunately, Semen Lutsenko is from Lidiyivka village of Domanivka district.  It is too modest format for “all-Ukrainian”. Probably, it is convenient for Semen Lutsenko; it makes no difference for him on what side to struggle against NIBULON.
Actions determine value of any organization. “Solidarity” has two such actions. The first one (and probably the second one after NIBULON) is to talk about problems of Ukrainian workers abroad. The second one is Oleksiy Vadaturskyy himself and his company in the context of “Lidiyivka drama” and, precisely, in terms of Semen Lutsenko’s interests.
The “Story about agrarian baron Vadaturskyy” should have one author with his arguments, strong position. And in this case, besides fantasies milled long ago, everything reminds mutual protection, the so-called “collective responsibility”. The first “episode” is Viktor Nesterenko, the second one – B. Antonyuk, a member of the board of organization, the third one – “Solidarity” management and another one – address to mass media.
Taking into consideration history and facts, Semen Lutsenko himself and his family should be the last ones to complain about “feudalism” or “barony” of Oleksiy Vadaturskyy. There is an application in the name of NIBULON’s General Director dated August 27, 1999, “I kindly ask you to allocate money in the amount of UAH 9 thousand for house purchase”. Money was allocated. Based on O. Vadaturskyy’s resolution, on October 16, 2000, Semen Lutsenko was given interest-free purpose-oriented loan of UAH 7 thousand (recollect 2000 and estimate the amount). Let us look through the list of those who received interest-free loan for five years, from 1996 to 2000. Totally, 46 persons received loans of UAH 200, 300, 500, about twenty borrowers – UAH 1-3 thousand. And only Lutsenko received UAH 7 thousand.  A significant fact: in 1999 less Lidiyivka people took loans; loan amount comprised UAH 250-850. 
According to the agreement, a loan must be repaid during 5 years in terms of instalments or deduction of 50% of monthly wage or payment of money to the cashier’s office in the amount of not less than UAH 116. And on July 01, 2001, Semen Lutsenko wrote an application, “I kindly ask you not to deduct loan because of illness from 1.07.2001 to 1.07.2002”. NIBULON’s General Director wrote his resolution, “To suspend deduction of loan till working capacity renewal”. What did O.O. Vadaturskyy “skin” from Lutsenko, a “miserable peasant”?
Lutsenko and his companions worry about village club. Why? For the last three years the company has invested UAH 270 thousand in Lidiyivka social projects; land lease payment amount comprised UAH 1.59 million in 2013-14 alone; and since 2006 the amount of payments to the local budget has comprised UAH 4.75 million. Annually, almost 200 citizens, former members of the collective agricultural enterprise (CAE) collective farm “Lidiyivskyy” additionally receive social payment from the company which amount will comprise almost UAH 6.6 million from 1999 to 2014… Totally, for the past ten years NIBULON has invested more than UAH 70 million in the social projects and infrastructure facilities of our country. Almost “feudal” like…
I wish “Solidarity” would visit Lidiyivka neighbouring village… Once there was a club, and now the so-called club can be reached by a narrow pass, overcoming bushes. The village council executive committee holds meetings in the house with broken windows. Though, this information is absent on the “Solidarity” website; probably, it does not have any “ideological” interest.
There is another story of “struggle with “oligarch” Vadaturskyy”. We could have paid no attention; different things happened. This concerns the country. Most public organizations took responsibility; public activists want to change quality of authorities. Everyone carries its burden: NIBULON carries social and economic one, public organizations – social one, and there are a lot of impenetrable paths. But “Solidarity” has chosen cheap “third” way – without efforts, responsibility, without minimal benefit for our country but for benefit of “fighters” of definite model.
Part II
Another “Fact” is Old Lie
Ways and methods of “fighters for justice” are very simple. Only computer is required. Credibility, validity, reasonableness are not important, as faith in demagogy and falsification inspires Semen Lutsenko and his “companions” to creative achievements. Long (and it seems endless) internet “series” about “agrarian baron” is the way Semen Lutsenko and Co. see Hero of Ukraine Oleksiy Vadaturskyy. It should be clarified here: only they see him in such a way, because Lidiyivka villagers have been living according to the rules of economically and socially prosperous farm – NIBULON’s branch RE “Lidiyivs’ke”. And all-Ukrainian society requires truth and not fictions. The society is fed up with lie.
The authors of another (fifth!) part described the so-called “fact 2”. Though, it could be both No.5, 8, 10 and 2 or 6… As there are no new “accusing” facts. Information is the same as in previous “parts”: baron Vadaturskyy deprived peasants, took away their land, material assets, main production means, destroyed prosperous social sphere. Artificiality of these statements has been confirmed several times not only by mass-media, villagers but also by public prosecutor’s offices, courts. Every time, losing the “battle”, Semen Lutsenko (he calls himself “peasants of Lidiyivka village” for some reason or another) complains about imperfection of judicial system. The system is really imperfect but not in Lutsenko’s case. He and his companions have got beyond bounds…
“Fighters for justice” (in fact, in order to justify their existence as an organization) probably do not understand that they work against themselves. As falsification is quite a concrete thing. There should be quoted the following information from the website “Solidarity”: “On October 10, 2013, on application of Lidiyivka citizens, a criminal proceeding for abuse of position and documentation falsification was opened against O.O. Vadaturskyy”. And then there are more interesting things in a thimblerigger style…
In “fact No.2” there is an extract that was not taken from a document but from a text that can be understood at will. We quote: “Investigator of Domanivka District Office of the Department of Ministry of Internal Affairs of Ukraine in Mykolayiv region Senior Lieutenant A.M. Arkhypenko observed materials of pre-trial investigation…
He established:
Within April (!) 1996 NIBULON’s officials, being in the administrative building of CAE (!) “Lidiyivskyy” in Lidiyivka village of Domanivka district of Mykolayiv region, issued consciously false document  – general meeting report of CAE “Lidiyivskyy” dated 29.04.1996, according to which, at the general meeting of CAE “Lidiyivskyy” there was decided to refuse right for collective land ownership and to ask village council to provide NIBULON with a land plot to organize a branch for producing agricultural commodities and seed, to cancel the decision about creation of CAE “Lidiyivskyy” and to transfer main production assets to NIBULON.
In order to describe the text precisely, some grammatical and stylistic moments are kept. But that’s not the point. Previously, the authors stressed that “investigation acknowledged the fact of criminal action beginning”. In fact, it is cardsharping of “fighters” against NIBULON. Facsimile has the following words over the quoted rows, namely “Town (city) Domanivka, June 08, 2014”. Only several rows were (accidentally) captured from the text. In reality, “acknowledgement of the fact of crime commencement” is absent, because above and below the text there is information that specifies the refusal of legitimate of claims. The quoted text is only a formal part without ascertaining a fact; the investigator does not say about “deliberately false document”; he cites an application of “Lutsenko’s villagers”.  What is false in advance?
The authors of the “story about Vadaturskyy” liked manipulation with document: this extract was used in “fact 1”. Genre crisis made companions of Semen Lutsenko use self-plagiarism.
It is not so difficult to capture (even carelessly) advantageous things, and the truth is in your pocket… Though, this “truth” did harm those who steal it. The above-mentioned text mentions CAE “Lidiyivskyy” several times (it is precisely to say “CAE collective farm “Lidiyivskyy”). “Solidarity” confidently mentions things that are denied in the “struggle”, namely the existence of this very CAE. If using text “cutting”, where logic is? We quote again: “…NIBULON’s officials, being in the administrative building of CAE “Lidiyivskyy”…” So what it was, as again this is a statement based on Mykola Lutsenko’s application or based on “peasants” application. It turns out that we name farm in such a way, but in reality it is different.
It is no coincidence that we accentuate the given topic, because Lutsenko and Co. consider it to be a “bomb” that can “blast” NIBULON in Lidiyivka village. In reality, it is directed against Lutsenko. Is it strange? Not at all.
It is very important for the authors of “the series about baron” to finally realize (and to convince those who believe them) that NIBULON and Oleksiy Vadaturskyy has no relations to the problems in “Lidiyivskyy”. Without NIBULON’s participation on March 05, 1994, at the general meeting of the collective farm “Lidiyivskyy” the villagers decided to rename the farm as collective agricultural company (CAE) collective farm “Lidiyivskyy”, to get collective land ownership.
In a year, in February 1995 at the general meeting of CAE collective farm “Lidiyivskyy” there was approved the Land Privatization Project of CAE “Lidiyivskyy” developed by Mykolayiv branch of the Institute of Land-use of Ukrainian Academy of Agrarian Sciences. By the way, it sounds quite scary in the anti-NIBULON’s “story”: “It was necessary to determine persons who gave the State Act of collective land ownership to non-existent judicial entity that was not created and to make decisions as to these entities”. Is it better to start with the villagers who decided to take land in collective ownership? The general meeting decision dated 05.03.1999 is a component of the Land Privatization Project.
How could general meeting of the non-existent judicial entity dated 29.04.1996 cancel the general meeting resolution of collective farmers of the collective farm “Lidiyivskyy” about creation of CAE? How could villagers refuse land that did not belonged to them? How could liquidation commission of CAE be created taking into consideration that CAE was not created? These are questions that worry Lutsenko and Co., as we are talking about different villages and different persons…
It should be mentioned that in 1994, several years ago, the notion “to rename collective farm as CAE” and “to create CAC” in terms of “letter” was not interpreted as it is interpreted now.
Collective farm has state form of land ownership; CAE has collective property, according to meeting resolutions. How could villagers refuse land that did not belong to them? This question worries “protectors of miserable villagers”. According to them, villagers were members of collective farm all those time, and land was in state use constantly. On which land NIBULON created the branch RE “Lidiyivs’ke”? Why do they say that Vadaturskyy “deprived” either one hundred or hundreds of Lidiyivka families (the story contains different variants)? In 1996 land has state form of ownership, when NIBULON came. This is fact. At first NIBULON obtained the right for constant land use from reserve land and then lease right.
One could imagine how NIBULON’s specialists sit in the administrative building of CAE (?) “during April” and fabricate the report No.4, where, by the way, there is an item “to cancel previously made resolution of the general meeting of the collective farm “Lidiyivskyy” that was held 05.03.1994 and 10.02.1995 as to renaming of the collective farm “Lidiyivskyy” as CAE collective farm “Lidiyivskyy”. Further it mentions voluntarily refusal of land plot being in collective ownership, according to the regulations of the Land Code and then it contains the petition as to providing NIBULON with a land plot to establish its branch there. Why did villagers petition for that, if they refused ownership right? Land was transferred to state property and reserve land … They have asked NIBULON’s management to take care about their village and farm for a long time.
Another fantasy of “story-tellers” is that “the main principle of O.O. Vadaturskyy in its business activity is to form relations with the authorities”. But the society is aware of oppressions the company faced since its existence, not from wild “usurpers” but from the authorities with a full set of such pressure – starting with fire-fighting and sanitary services and public prosecutor’s offices, police and Security Service of Ukraine… Take alone “high” proposition from the most imposing people: to share half of business in exchange for monopoly in the grain market. Those people who are aware of this proposition understood that NIBULON had to agree to destroy his competitors the same way the authorities wanted to destroy it. It is obvious that Oleksiy Vadaturskyy rejected such an attractive perspective that caused a lot of inspections, including criminal proceeding. For example, the Security Service of Ukraine examined the company’s employees for hours. “Solidarity” activists can imagine the meaning of inspections for every NIBULON’s branch. In spite of the fact that the branches activity is considered to be model, supervisory bodies had a definite task and aim, namely to find anything to destroy the company or to sell it forcedly. Thus, thousands of families could lose wage and social support (Do “protectors” care about it?). They did not succeed.
What concerns Lutsenko and his companions much? Oleksiy Vadaturskyy protects his dignity and business reputation. Probably, the opponents worry for not understanding these very important categories. We face streams of mud against the person who is trusted in many countries of the world. We have already mentioned high appraisals of Oleksiy Vadaturskyy and NIBULON’s activity from representatives of international and national economic, financial institutions, business circles. Though, “Solidarity” is not behind this issue. The organization “is not interested in business reputation of NIBULON headed by O.O. Vadaturskyy. This is his business and he skillfully copes with it. Vadaturskyy should be given credit for this”.
Every person has the right to defend his honour in the course of judicial process. It appears that it is possible to make some things without being punished. Lutsenko thinks in such a way. Public statements of a “fighter for justice” are just trifle. In general, it is well-know that every word must be confirmed by facts; otherwise, it is slander. Absolute nonsense is that “Vadaturskyy gives conditional share, issues sponsor assistance in order to pay fewer taxes”. Did you think hard?
Lidiyivka village social program, its implementation is not a secret for Semen Lutsenko, if he lives in Lidiyivka village of Domanivka district of Mykolayiv region and not in other Lidiyivka. Let us start with “landless”. Those who wished received up to 3 ha to do housekeeping. Such facts as the increase of material assistance and annual social payments from 3 to 4 % of normative pecuniary valuation of land (about UAH 6 million since 1999) since 2013 and interest-free loans allocation are considered as “robbery of villagers”. Finally, according to Lutsenko, renovation of the village school, wage payment to teachers, repaired village roads and house of culture, kindergarten, water supply system in every house are “eyewash” … Since 2006 the company has paid taxes in the amount of UAH 4 million.
Lutsenko’s efforts to describe events in his own way are useless; Lidiyivka people have good memory and his fantasies about “destroyed animal farm, removed and robbed agricultural machinery” are beneath criticism. People remember scrap metal instead of those “machinery” before NIBULON arrived… NIBULON’s critics are indignant at highly productive foreign machinery in Lidiyivka village, highly productive foreign herd instead of half-dead domestic cattle. Rights for “jingoism” have not been taken away from anybody. What do we have to do with general public here? Why do people have to think in what way NIBULON, implementing its social program in Lidiyivka village, tries to avoid paying taxes?  In this case it is hard for Semen Lutsenko to explain anything to himself.
Real ownership of land does not always mean prosperity of villagers. It is another topic, moreover (it is said hundred of times) NIBULON has no relations to land share in Lidiyivka village. If activists of “Solidarity” left their computers and came to Domanivka region, they would see how the amount of social payments and activity in the social sphere of RE “Lidiyivs’ke” differ from the situation in many other villages. Not every farmer having leased land takes serious responsibility to solve social issues. A wonderful phrase from the “story” about Oleksiy Vadaturskyy, “People of Lidiyivka village want to live not “conventionally” but in reality, using current laws of Ukraine”. Real life, according to Semen Lutsenko, is poor local budgets, broken roads, absence of water supply system, destroyed farms, broken machinery. One should confess that many our villages face these problems.
The problem is that neither Lutsenko nor his companions paid attention to arguments, and then they are indignant at court decisions as to dignity and honour protection. Probably, these categories are an abstraction for them. These “pearls” are worth nothing.
“NIBULON’s management consists of criminals…” We will not even comment this; as such a statement probably is under protection of “real Ukraine’s laws” known only to Lutsenko. Semen Lutsenko is not able to understand why O.O. Vadaturskyy was acknowledged Hero of Ukraine title. Indeed we have to remind the company’s history who moved against stream, implemented civilized rules of doing business in Ukraine and did a lot of things so that our country may be among leaders of agrarian partners…
“He robbed Ukraine, removed grain…” Everybody knows that every country in the world strives for increasing export of its products that means payments to the state budget and currency growth. Ukraine does not differ from them, except grain wealth. In terms of inner provision there are no problems in the country; grain residues are exported. It is just literacy campaign, but it is interesting to know what “Solidarity” would do with Ukrainian grain…
If the activists of this public organization relied on real facts in their stories, Oleksiy Vadaturskyy and NIBULON would forget about its existence. The “series” would be finished without beginning.
