NIBULON Denies the Statements made by Natalia Kostenko in the “Good Evening” Program on the NIS-TV Channel (November 25, 2019)

These manipulations have nothing to do with the professional journalistic activity and are always contested by our company. For example, the STOP Corruption media has recently spread an openly biased “research” and published it on the NikVesti website.Now it is the “Good Evening” program that provided a one-sided view of the situation concerning NIBULON’s idea to construct a transshipment terminal at the entrance to Matviivka microdistrict. It seems to have been done on purpose. The mass media uses a manipulative propaganda technique, whenby only one party has an opportunity to share views. Thus, the pseudo-journalists create a mistaken perception, i.e. an author aims at making everyone believe that the “majority” of experts accept a viewpoint required for this very author.Actually, the “Good Evening” program’s guest, Natalia Kostenko, can hardly be considered an expert. She is introduced as a Matviivka citizen and the Mykolaiv city council deputy of the 4th convocation. Vitaliy Mekheda, the program’s author, does not explain why she is entitled to express the public or expert opinions about environmental or judicial issues. He also does not mention that Natalia Kostenko is a former city official, and she is now working for one of Mykolaiv companies in the marine economic sector. Consequently, we are talking about a conflict of interests and a strong bias towards NIBULON.From the very start Natalia Kostenko has stated,“On October 18, 2019, a public hearing was held at NIBULON’s terminal construction at a distance of 50 metres from the houses. We did not understand what those public hearing was about”. Firstly, Kostenko tells lies by saying this. NIBULON published its statement of intent and informed about the public hearing in the Vecherniy Nikolaev, Ridne Prybuzhzhzia newspapers, on the notice board of Matviivka house of culture as well as on NIBULON’s official website. Secondly, the company announced its idea to construct the terminal at the entrance to Matviivka microdistrict in 2016, having addressed it to the city mayor. In 2018, the City Planning and Architecture Department of Mykolaiv City Council replied that this issue would be considered during the renewal and amendments to the existing Mykolaiv general plan.Natalia Kostenko stated, “The transshipment terminal construction upsets Matviivka citizens, and according to the survey, the majority will be against the construction…” This is biased information as well. She uses a technique to make people think that it is the “majority” opinion. In reality, Matviivka public opinion is totally different. According to the public hearing on October 18, 2019, most of the participants supported the transshipment terminal construction. Matviivka citizens have sent the city mayor several collective appeals with about 1,000 signatures to support the construction. In addition, the members from the Matviivka Veteran Council (Central district) informed the city mayor that they supported the planned construction.The problem is that NIBULON’s supporters face threats from such “experts” like Natalia Kostenko.  For example, teachers from Matviivka comprehensive secondary school, as well as other Mykolaiv citizens, have the legal right to give their own points of view.The program’s guest stated, “In accordance with the land cadaster, the site where NIBULON plans its construction belongs to the residential and public development as well as to the beach area… Aragor Ltd leased this land plot for an unknown period. If a land plot is not used, the lease is cancelled. The lease termination is not specified in the register”. This is false information. In 2014, Aragor Ltd actually leased this land plot. The tenant has not started constructing its facility during the lease period. In 2016, the lease period was completed, and the contract was terminated. Thus, currently, this land plot belongs to the communal property. She is incompetent and is not ready to comment on this issue. In general, it is difficult to understand what she meant. If she was talking about the State Registry of Real Estate Property Rights, the Aragor Ltd leasehold right could not be registered there and, as a result, terminated. When the contract was signed, another registration procedure was in force.The guest’s incompetence is proved by her other statement, such as “constructing in the living area is violation…” NIBULON always works transparently and within the legal framework, meeting the current legislation requirements. Otherwise, the international financial institutions would not work with the company. The company has a perfect long-standing credit history, trust, and respect of the world’s best banks. We are not going to violate these principles during the transshipment terminal construction. In accordance with the current Mykolaiv general plan, part of this territory belongs to an area of possible residential development and recreation. In order to construct the terminal, amendments must be made to the general plan. Its target use must be changed to industrial, transport, connection, energy, defense land plots. Our company has addressed the city council, having publicly announced its investment intentions. “The company will allegedly transship something else” is also a manipulative phrase she uses. Our company stated about its intent to construct the transshipment terminal for grain and oilseeds.  Taking into account this cargo nomenclature and the amount of cargo transshipments (annual, daily, hourly), NIBULON will develop project documentation, choose technological equipment and techniques, and develop methods to minimize and prevent negative impact on the environment. Based on the project decisions, an occupational hazard class and a sanitary protection zone are defined. We do not plan to change this nomenclature. If we had chosen to change it, we would have done the same procedure, namely to develop project documentation, to hold a public hearing to asses the impact on the environment,  undergo a state comprehensive expertise, get a building permit as well as emission permits and waste management. It is obvious that N. Kostenko again proves her incompetence by stating this information.Concerning her phrase that “a stable is being constructed very close to the future terminal” , we would like to note that the city council gave the land plots to the ATO soldiers in 2012 to construct and serve residential building, household buildings and structures, i.e. the land plots are intended for residential development. In 2019, an individual bought all these land plots, but their target use has not yet been changed. Consequently, I doubt whether a stable is being constructed legally.   The arguments that this construction “will violate sanitary norms, and the terminal’s proximity to the houses must be not less than 300 m” are manipulations as well. The state sanitary rules and regulations for the sea and river ports are approved by the Decree of the Chief State Sanitary Doctor of Ukraine, dated 01.12.1999, which control the operation of the sea and river ports, depending on the technologies used and nomenclature of cargoes transshipped. In accordance with these standards and taking into account the sanitary characteristics of processed cargoes, cargo amount, transshipment technology and measures to prevent harmful emissions into the atmosphere, NIBULON’s transshipment terminal falls into the category of facilities requiring a 100 m sanitary protection zone, as the transport and technical schemes at our facilities exclude dust emissions into the air. The company submits all its projects to the comprehensive state construction expertise which specialists, including experts in human life and safety, environment protection, sanitary and epidemiological welfare of the population, carefully consider them. All NIBULON’s facilities were approved by this expertise. (According to its conclusions, NIBULON’s facilities have a 100 m sanitary protection zone: the construction project in Nova Odesa town – a conclusion of the State Ecological Expertise No. 14/12.08.2010-1177, dated 16.09.2010, a conclusion of the State Sanitary and Epidemiological Expertise No. 05.03.02-07/68387, dated 22.09.2010; the construction project in Voznesensk district – a conclusion of the State Environmental Expertise No. 14/16.09.2010-1280, dated 27.09.2010, and a conclusion of the State Sanitary and Epidemiological Expertise No. 05.03.02-07/85413, dated 08.11.2010).There is another evidence of manipulation. Natalia Kostenko insists that “the construction will have a negative environmental impact downstream, in particular in Varvarivka and estuary..,”, “it is prohibited to build downstream in order to avoid oil spills”. Is this “expert” aware that is impossible to deteriorate water quality in Soliany microdistrict and Varvarivka as a result of NIBULON’s operation in Matviivka? Oil spills can be caused by a serious man-made disaster by spilling more than one ton of oil products into the river. Thus, all these statements are untrue and unreasonable, as the land plot is located downstream from the houses in Matviivka microdistrict, thereby meeting the sanitary legislation requirements. As to other microdistricts about which N. Kostenko worries so much, please note that Varvarivka is located on the opposite river bank at 2 km, and the residential buildings in Soliany microdistrict are located downstream at 2.5 m. NIBULON implements a number of protection activities to minimize any possible impact on the environment at all its facilities:- NIBULON uses the European technology to clean domestic sewage water, namely complete biological cleaning with a membrane ultrafiltration method, using МITSUBISHI RAYON membranes (Japan);- rainwater, melt water, and wash water are gathered and cleansed of oil products;- the company’s fleet is new; all the vessels are equipped with the closed sewage systems meeting the requirements of the International Convention for the Prevention of Pollution from Ships (MARPOL 73/78), which is confirmed by the international certificates to prevent air pollution by oil, sewage water, garbage, issued by the Shipping Register of Ukraine;- the vessels are served at the company’s berths equipped with a water supply system with a fresh water hydrant, a sewage system with a pump unit to receive sanitary sewage water, and a site equipped with accident prevention devices to fuel the vessels from a tank truck.I wonder if Natalia Kostenko is incompetent in this issue or whether she purposefully misleads the TV viewers. The phrases, such as “it can hardly be called an investment project…. How will Matviivka benefit from it? Traffic load on the roads won’t be reduced…The company has a terminal in the city, and the trucks will still move there…”, testify total ignorance about the project itself. Probably, she is using a manipulative technique to make people believe in false facts without using reasonable arguments and objective reasons. In reality, an idea to construct the terminal is our solution to remove trucks from Mykolaiv. As a result of the transshipment terminal construction, the company’s trucks as well as our partners’ vehicles will not enter Mykolaiv.The trucks will move to the terminal though an access road, without using the Matviivka main road.N. Kostenko uses suggestion techniques, stating that “the site is a beautiful place to arrange a beach area there… There are red feather grass and spring water”. This territory has a difficult landscape with high hills and wild bushes. Considerable investments are required to make this territory ready for not only the transshipment terminal buildings but also for any other facility as well as a beach area. At present, this territory is extremely deserted, and I doubt whether it is possible to use it as a recreation area. I wonder why our critics, dreaming about a beach area there, still do nothing to make it clean.There are totally senseless and incompetent phrases concerning “the installation of 120 tanks at the site” (What are you talking about?), “Nova Odesa citizens suffer from dust and noise” (Are you serious?), “grain must be turned in tanks and chemically treated” (We don’t know where N. Kostenko has inspected this technology, but it has nothing to do with NIBULON’s activities),“NIBULON’s terminal operates in Yuzhnyi town” (We have never constructed any facility there), “not more than 60 workplaces” (it is her imaginary figure), “trucks will be at a parking place round-the-clock” (Everyone can come and see that there are no truck queues at our transshipment terminal). Isn’t it too much false and unchecked information for one “expert”? Probably, she aims at misleading people. I wonder why the TV host does not ask any clarifying questions and does not object to obvious nonsense and lie? Can this product be called journalistic? I doubt.Our company is a city’s patriot. Since NIBULON started its operation, its central office is located in Mykolaiv. We care about the city's future. It is possible to make a successful port city by developing logistics properly and by creating cooperation between business and community. Probably, somebody does not want Mykolaiv to be successful…Despite these lies, we are not going to give up. We sincerely believe that common sense will prevail.

Він прийняв цю посаду після трагічної загибелі свого батька та засновника «НІБУЛОНу» Олексія Вадатурського разом із матір’ю Раїсою Вадатурською під час російського ракетного удару по їхньому дому в Миколаєві.

З 2014 до 2019 рік був народним депутатом України від одномандатного округу в Миколаївській області та членом Комітету з питань аграрної політики. У 2017 році створив і очолив велику міжпартійну групу, яка виступала за розвиток українських річок як транспортного засобу.  

Має ступінь магістра електротехніки Українського державного морського технічного університету та ступінь магістра економіки промисловості Лондонської школи економіки. У 2009 році за вагомий внесок у розвиток агропромислового комплексу України був нагороджений Президентом України, йому присвоєно звання «Заслужений працівник сільського господарства».

Одружений, має трьох дітей.
