The statement says:“The criminal proceedings were registered by the Prosecutor General of Ukraine on the statement of the People’s Deputy of Ukraine, a member of the BPP faction Andriy Vadaturskyy, who as well as the leader of the party has his own interests in the shipbuilding industry. NIBULON, whose co-owner is Andriy Vadaturskyy, is a direct competitor of Chornomorskyi Shipbuilding Yard in the field of shipbuilding and cargo transshipment”.
We officially state that NIBULON has nothing to do with any criminal proceedings, inspections and other actions by law enforcement and other public authorities regarding Chornomorskyi Shipbuilding Yard, its officials and owners, as well as regarding other enterprises, which are part of Smart Holding.
Firstly, we have not considered Chornomorskyi Shipbuilding Yard or any other shipyards as objects for acquisition, transfer, etc. Therefore, we are not interested in the possibility of shipyards privatization.
The leading financial institutions, in particular the International Finance Corporation, the European Investment Bank, the European Bank for Reconstruction and Development, as well as first-class western and Ukrainian Banks, with which we successfully cooperate, are thoroughly acquainted with the company’s development strategy. They are also aware that we do not plan to increase our capacities through takeover, merger or acquisition of new enterprises.
By the way, we maintain good neighborly and partnership relations with various shipyards, including those that are part of Smart Holding (Chornomosrkyi Shipbuilding Yard, Kherson Shipbuilding Yard). And we are not involved in corporate wars.
Secondly, it is enough for us to have the existing shipbuilding capacities for the implementation of strategic plans and successful development of our company.
We didn’t plan to be engaged in shipbuilding and hoped that already existing shipbuilding enterprises of Mykolaiv will be able to build all our orders. But after the forced construction of the vessel at the Romanian shipyard, due to the stoppage of Mykolaiv shipyards, we decided to buy a small, abandoned shipbuilding enterprise. Today we are actively reconstructing it and already this year we will be able to build complete 140-m long vessels. We showed our previous achievements during last year’s international shipbuilding exhibition, which was organized and held in the territory of our shipbuilding and repair yard. This year we plan to hold a similar event and to demonstrate our new achievements and relevant innovations in Ukraine and in the world.
Thirdly, shipbuilding is not our company’s core activity. Of course, we would be able to resume the work of large shipbuilding enterprises, if needed. But for this purpose it is necessary to completely change the company‘s core activity. And we have no such plans and need.  
Fourthly, as an export company, we are actively leaving Mykolaiv, redirecting a significant part of our cargo to the rivers. While successfully implementing our investment project to revive the Dnipro and the Southern Buh Rivers as the main transport arteries of Ukraine, we minimize the receipts of agricultural products from road transport at the transshipment terminal in Mykolaiv.
Fifthly, Andriy Vadaturskyy, as a People’s Deputy and a citizen, has a right to his own position. But his political activity is completely separated and not related to the economic activities of our company. Yes, he is a co-owner of NIBULON, but in 2014, right after his election to the Verkhovna Rada of Ukraine, Andriy Vadaturskyy transferred his share (in full amount) in the authorized capital of the company to manage this share. And from that moment Andriy Vadaturskyy did not participate in the operational management of the company.
Therefore, any statements or innuendos concerning the alleged involvement of NIBULON in bankruptcy proceedings, the initiation of certain inspections by law enforcement or controlling bodies, the shutdown of Chornomosrkyi Shipbuilding Yard or other Mykolaiv shipyards are false and groundless.
