Success and dynamic development of NIBULON, one of Ukraine’s largest agricultural producers, bother provincial provokers who are ready to take thousands of hectares of well-attended fertile land, ruining the results of laborious work of thousands of families from Lidiyivka village (Domanivka district of Mykolayiv region). Recently two unfamiliar Internet resources have published slanderous articles as to NIBULON’s activities. On August 7, 2013, on the website “Ukrzahidinform” (http://uzinform.com.ua) there was published an article “From the cycle about raids in Ukraine: Mykolayiv region” (hereinafter referred to as “From the cycle…”. On August 11, 2013, on the Internet resource “Ukrainian national and patriotic internet newspaper “Red and black alternative” (http://red-black.org.ua) there was published an article “The agricultural company NIBULON threatens villagers with police reprisal and public defenders are threatened with courts” (hereinafter referred to as “The agricultural company…”). NIBULON considers both texts to be false, unproved, unreliable which aimed at blackening the company’s reputation and humiliating honour and dignity of Oleksiy Vadaturskyy. Statements published in the articles are based on words of Semen Lutsenko, an inhabitant of Lidiyivka village, and his assistants. S. Lutsenko blames NIBULON for illegal management of land belonging to Lidiyivka inhabitants who voluntarily refused to share the land for benefit of more efficient use by NIBULON’s branches. S. Lutsekno’s actions were recognized as illegal and his statements as false by a number of court decisions. He did not give notice of appeal, thus, agreeing with them. Repeated confrontation with Oleksiy Vadaturskyy indicates S. Lutsenko’s personal hostility. Chronology of S. Lutsenko’s personal hostility to NIBULON April-May 2005 S. Lutsenko provoked 31 workers of RE “Lidiyivs’ke” branch to carry out illegal strike consisting in non-performance of labour obligations, creation of obstacles to perform spring field works. Dominavka court recognized the strike as illegal. The company refused to recover damages done by the “strikers”. It is confirmed by a Peace Agreement approved by the court (May 2006). During that period S. Lutsenko spread information about O. Vadaturskyy which unreliability was confirmed by the court. July 2007 S. Lutsenko’s wife Galyna sent O.Vadaturskyy a letter with threats and white powder of unknown origin.  The law-enforcement authorities considered it as disorderly conduct, and S. Lutsenko was made administratively responsible. September 2010 S. Lutsenko with participation of the public organization “Cooperation and success” incites Lidiyivka people to illegal strike, he spreads provocative letters, initiates meetings. But the inhabitants of Lidiyivka village did not support him and through Head of Suhorabivka village they addressed to the court in order to prohibit these meetings in the territory of Domanivka town and Lidiyivka village. Mykolayiv circuit administrative court issued an appropriate order. October 2010 At a press-conference S. Lutsenko and Vitaliy Kobzar, a head of the public organization “Cooperation and success”, spread false information about NIBULON. Till December 2011 the Court of Appeal and first instance court recognized it as unreliable, and V. Kobzar compensated moral losses.   However, the authors of the article “The agricultural company…” decided not to pay attention to the operative part of the resolution that obliged S. Lutsenko and V. Kobzar to disprove unreliable information. They published their own interpretation, namely according to the judicial decision dated 05.10.2011, Domanivka district court “recognized land share right of the villagers and obliged the public prosecutor’s office to establish the way the land was disposed”.   This statement is wrong, as the subject of judicial dispute was to recognize S. Lutsenko’s information as unreliable and not to recognize land share right of the villagers and to oblige the public prosecutor’s office to establish the way the land was disposed.Also, in October 2011 and later on disputes as to land share right of the members of the former collective farm “Lidiyivskyy” were not considered by Dominavka district court. No decisions were made. NIBULON did not receive any claims concerning land share rights.   November 2012 S. Lutsenko with participation of “Solidarity” representatives headed by Viktor Gorobchuk incited Lidiyivka inhabitants to make protests. This time the inhabitants did not support provocative actions and the court prohibited to conduct meetings in the territory of Lidiyivka village.   Despite S. Lutsenko and his “assistants”-provokers did not appeal against this judicial decision, on November 22, 2012, in an office of the online newspaper “Zadyra.Info (Mykolayiv city) during the press-conference “Formation of feudalism in Mykolayiv region” V. Gorobchuk and S.Lutsenko spread false information about NIBULON and Oleksiy Vadaturskyy again. The court obliged both of them to disprove information. In the current year there are no proceedings initiated by NIBULON or its General Director. Thus, the statement in the articles that “at present at court there are a number of proceedings against public leaders who were not afraid of telling about criminal actions” is wrong.   Short history of “Lidiyivka issue”   According to the Land Code acted on 1996, voluntary waiver of collective land ownership and land use right corresponded to the legislation provisions. Lapse of collective land ownership was performed according to the decision of the appropriate Council of People’s Deputies. According to this very decision, on July 17, 1996, NIBULON got an official act allowing permanent use of land from land reserve. Within last years legality of land transfer to NIBULON was checked by the public prosecution bodies of all levels for several times. There were discovered no crimes on the part of NIBULON’s managers or local authorities.   In compliance with the Land Code new version came into effect on January 1, 2002, NIBULON could not acquire right of permanent use of a land plot belonging to state or collective ownership. Till January 01, 2008, the company had to reissue ownership or tenant right in the prescribed manner. In May 2006 NIBULON leased land of Lidiyivka village (2628,59 ha) for a period of 25 years according to the order of Domanivka District State Administration. NIBULON did not get land ownership.   Thus, the authors’ statement as to transfer of “land shares (2300 ha) to NIBULON” is false, as well as “criminal proceeding against NIBULON’s General Director Oleksiy Vadaturskyy and Head of Village Council Babanska” as to land transfer. Head of Village Councilwas not able to dispose land which is leased by NIBULON now; only the district administration had such a right.   The authors and clients of the article “Agricultural company…” refer to “assault and battery” of one of the inhabitants of Lidiyivka village. According to them, this action shows hostile mood of NIBULON against Lidiyivka inhabitants. The company has conducted its own investigation and found out that at the beginning of August there was fight between employees of RE “Lidiyivs’ke” branch. But this conflict is connected neither with land issues nor with membership of one of the fighters in “Solidarity” organization. The reason for fight was disappearance of personal property of one of the squabbles.   There should be added several words about Lidiyivka village which is described as “labour ghetto where only loyalty to raider can help to earn one’s crust”.   Since NIBULON established its branch in Lidiyivka village, the company invests more funds in the development of production and social programs than receives from the sale of yield.   Since 1996 till now: unpaid wages of the collective farm “Lidiyivskyy” have been paid completely, wage is paid twice a month and indexed every month, the employees receive different kinds of material assistance and annual social payments in the equivalent of 3%, and since 2013 – 4 % of the normative monetary value of land (since 1999 – more UAH 5.5 mln); interest-free consumer loans are provided; there have been reconstructed a farm, a barn floor, a summer yard for animals; new agricultural machinery has been purchased; livestock has been changed, and the branch becomes a reproducer of Angler breed of cattle; an amount of rental payment is UAH 795 thousand for 2013, and since 2006 the local budget has received UAH 3.95 mln; NIBULON has been financing Lidiyivka local school including catering (during long time the company even paid wages to the teachers); the local kindergarten and the house of culture have been repaired; streets have been illuminated, every house has a water supply system; the roads have been reconstructed; accommodation for NIBULON’s employees has been constructed.  Thus, the authors and clients of the articles try to pervert events and facts, but we are sure that our readers are able to separate the wheat from the chaff.  And theseprovocationswill not influence well-coordinated work of one of the best branches of NIBULON.
