The representatives of the information site Stopcor and Information Agency “Stop Corruption TV” Ltd. continue their information attack against NIBULON. Pseudo-fighters against corruption do not hesitate to use dirty methods against our company. On October 16, having published another slanderous article “Removing Competitors and Bribing Judges: a New Corrupt Story of Nibulon” on Stopcor, and in addition to other violations of Ukrainian legislation, they committed a criminal offense; they illegally disclosed the information constituting the secret of pre-trial investigation.
In this regard, on October 17, 2018, the Prosecutor General’s Office was notified of a criminal offence (in accordance with the Article 214 of the Criminal Procedure Code of Ukraine) and was requested to start a pre-trial investigation of the criminal proceedings.
In addition to violating the provisions of the Criminal Code of Ukraine, the Constitution of Ukraine, the Civil Code of Ukraine, the Code of Ethics of Ukrainian Journalists, members of the Stopcor team and representatives of Information Agency “Stop Corruption TV” Ltd. continue to deliberately manipulate information, distorting and fabricating it in favor of interested parties. In particular, speaking about a dispute of NIBULON S.A. and Rise Company PJSC (we have already presented real circumstances and history of the case, which has lasted since 2010, on the website and it has been repeatedly exaggerated in the media), an anonymous author of the article tries to mislead the readers and deliberately conceals the fact that after repeated reconsideration of the Award of Sviatoshyne District Court dated 30.01.2015,  the application of NIBULON S.A. was fully satisfied by the Award of Kyiv Court of Appeal dated 06.12.2017. It recognized and permitted to enforce the GAFTA Arbitration Award in the territory of Ukraine.
Therefore, all actions of NIBULON S.A. and its representative, NIBULON’s deputy general director Andriy Vasylyev were exclusively within the framework of Ukrainian and international legislation.
Thus, the award of the international commercial arbitration (GAFTA) is recognized by the competent national court of Ukraine. Its award was verified by Her Majesty’s High Court of Justice in England and was approved by the Grand Chamber of the Supreme Court of Ukraine. And it should be carried out throughout the territory of our state. It is very strange that after many years of litigation, after awards of such important bodies, including international ones, “Stop Corruption” questions the validity of these awards. This is legal nihilism. We were not the first to open Pandora’s Box and we were not the first to address ourselves to law enforcement authorities. The debtors initiated blocking of the execution of judicial decisions. On July 3, 2018, Main Investigation Department of the National Police of Ukraine initiated a pre-trial investigation of criminal proceedings No. 12018000000000405 on the fact that officials of Rise Company PJSC failed to execute the Award of Kyiv Court of Appeal dated 06.12.2017. The investigation continues. That’s not you, pseudo-fighters against corruption, should question these issues and deceive the public.
We hope that a fair solution will be found, and Rise Company PJSC will be forced to pay the debts. After that we will show the whole history of the legal dispute and non-civilized resolution of issues by our contractor.
Having fabricated another article, Stopcor tried to present another legal decision of the Supreme Court of Ukraine in a negative way. In particular, we are talking about the fact that on July 3, 2018, the Supreme Court of Ukraine put an end to a long-standing dispute over violation of Ukraine’s legislation on protection of economic competition by Ukrainian Railway PJSC.  The court agreed with the Resolution of Kyiv Economic Court of Appeal on the recovery of UAH 120,283,293.60 losses in favor of NIBULON Ltd. In almost 27 years of our activities, we have become convinced that the key to successful and efficient operation of NIBULON Group is clear and strict adherence to the current Ukrainian and international legislation. And our long-term cooperation with the leading financial institutions is another indisputable proof that we are a law-abiding company.
In general, analyzing the information on Stopcor, it seems that NIBULON does not have to defend its rights and interests at all, and, moreover, we must be deprived of the right to legal protection at all. But we work within the legislation. We defend and we will defend our interests. And those who refuse to pay debts, various blackmailers and those who use mudslinging will bear responsibility for their actions.  This is our position.
We hope that the investigation of criminal proceedings will be carried out objectively, comprehensively and in a short time, and those who committed the offense and involvement in this violation of the representatives of Stopcor site and Information Agency “Stop Corruption TV” Ltd. will be find out.
