It is about program “Stop Corruption: “NIBULON’s Credit Secrets” broadcast on Channel 5 on June 3 and a number of articles derived from the above-mentioned program to create a wider resonance around false information.
Since the very beginning, the journalists resorted to deception. At first, journalists from “Stop Corruption” asked for an interview with Andriy Vadaturskyy as representatives of ICTV channel. Then, in Switzerland, as it been known from the video, these journalists were introduced as journalists from “Stop Corruption” on Channel 5. The same journalists came to General Director Oleksiy Vadaturskyy also as “Stop Corruption” journalists, on Channel 5.
Moreover, they came to a so-called interview without press cards and editorial task. They had only a microphone with “Stop Corruption” logo. Seeing these people for the first time, Oleksiy Vadaturskyy asked them to provide the relevant documents. However, they began to talk about the “human factor” due to which they did not take any documents with them. Of course, Oleksiy Vadaturskyy was not satisfied with this situation. And when they have been said goodbye, they offered a card of the cameraman. But the result of the meeting was obvious. As it happens in any serious institution or company, Oleksiy Vadaturskyy asked them to bring documents next time in order to, at least, understand who he is communicating with. By the way, we offer you to familiarize yourself with these pseudo-fighters against corruption. 
The fact that the program contained false, biased, unverified, selective information with hoaxes, speculation, elements of blackmail and deception, which has already been repeatedly publicly denied by the company for several years, speaks to the paid nature of the information. Some information is over 10 years and it has been mothballed several times. In particular, about alleged:
– unprecedented tax incentives (NIBULON is probably one of those few Ukrainian companies, which along with its agrarian branches, has been working under general system of taxation since 90’s, without any incentives, subsidies or any special tax regime. Do you see the difference? We can explain using arguments but not empty words);  
– privatization of the port’s part (the principled stance of our company we publicly declare is that we have never taken part in privatization processes. And this is one of our strong points. We have built all our facilities by ourselves. In addition, we constantly face the harassment of the Ministry of Infrastructure of Ukraine and state ports. The number of such situations does not decrease, so Oleksiy Vadaturskyy has been forced to publicly address himself to the President of Ukraine on this issue during his visit to our shipbuilding and repair yard on May 23, 2018.  The video of this appeal is freely available. Please provide documents if you find ports or other property or companies privatized by us);
– complete monopoly in the agricultural market (!) of Ukraine (we thank the journalists of the ENG crew that our success causes such a “wow effect” for them. Of course, poorly qualified experts, who do not know that the Ukrainian grain market, fortunately for agricultural producers, is one of the most highly competitive markets in the world, helped them to come to such a conclusion. This is a kind of a visiting card of Ukraine. There are more than 2,200 exporters of agricultural product registered in Ukraine, among which the most famous trading houses – Cargill, Bunge, Cofco, Glencore and many others. We are especially pleased that, despite such high competition, our Ukrainian (!) company is a leader. But the reason for this is the fact that we invest in Ukraine’s economy more than these large international companies.  There are 300 elevators operating in Ukraine. So, agricultural producers have a wide range of partners to choose. In such a situation, there is no chance of setting prices at all, for professionals, of course. We officially declare that there is no extra profit in this area of ​​activity. This is a myth. It is a risky business, and it is often accompanied by losses. And for “experts” and journalists, we announce that we have been publishing purchasing prices for agricultural products since 2004 because we have nothing to hide);
– minimization of taxes and tax evasion (only in last five years of its activities, NIBULON has paid more than UAH 1.8 billion of taxes and fees. The journalists used in their program the ten-year false statements of Hennadii Zadyrko. Based on these false statements about alleged tax evasion and minimization, use of offshore, price reduction, etc., a letter with a forged signature of Mykola Shchurikov, first deputy of Delta-Pilot SE, was sent to the Prime Minister of Ukraine.   Appropriate official inspections were conducted on this occasion, but the facts set out in the letter were not proved. We can talk a lot about it, but this fact does not deserve special attention. By the way, we have already published a denial of this information. And if you respect yourself and your audience, if you want to be trusted in the future, you should have paid attention to the fact that this is a refuted information); 
– existence of many offshore structures and elevators of the company (NIBULON’s branches are located in 12 regions of Ukraine. Apparently, journalists again “unintentionally” confused regions with foreign states. In general, our two foreign subsidiaries were established in accordance with the requirements of Ukrainian and international legislations. Both subsidiaries were named NIBULON, as a Ukrainian one (we do not establish companies with other names, we have nothing to hide). Oleksiy Vadaturskyy is a Managing Director of Nibulon Trading B.V. and all divisions of Ukrainian company NIBULON. He is also Head of the Swiss company Nibulon S.A. This information is indicated in the registers of the respective countries. The structure of the company management within the company in Ukraine and abroad is the same. We do not have many legal entities. We use the principle of a single legal entity and group in accordance with best international practice. Today, we have no enterprises (including elevators, etc.) abroad. But we are confident that after a while they will appear and will bring benefits for Ukraine’s economy, as well as create conditions for Ukraine’s independence in the global grain market. Our company is invited to invest in other countries. And we will definitely use this, as we regularly inform our stakeholders);
– inevitable corporate default, and blackmailing (!) the EBRD (and this is taking into account the fact that primarily thanks to the EBRD NIBULON has invested almost USD 2 billion in Ukraine’s economy. And by July 1, 2018, we will redeem the last loan allocated by the EBRD. NIBULON will not be in debt to the EBRD. Although it will last for a certain period of time – by the time we will start constructing new terminals on the Dnipro River in Zaporizhzhia and Dnipropetrovsk regions this year, starting from autumn. More than 200 contracting organizations (more than 3,000 builders) are waiting for this investment. They want to work in Ukraine, and not to move to other countries by whole brigades in order to earn money. In general, we are convinced that together with the European Bank for Reconstruction and Development, the European Investment Bank, the International Finance Corporation and other financial institutions, we will construct more than one facility not only in Ukraine, but also abroad);
In pursuit of “sensation”, journalists have even invented a story about the non-existent real estate of the family of Oleksiy Vadaturskyy in Switzerland and their “desire” to move and reside there.  The journalists have excelled themselves. So, we decided to launch a competition: if someone finds foreign real estate, planes, yachts possessed by Oleksiy and Andriy Vadaturskyy, he/she will have an opportunity to spend some time there for free. Good luck! To be serious, absence of real estate owned by the Vadaturskyy family confirms the fact that refutes even plans of moving to a permanent place of residence outside Ukraine. The General Direcor has a citizenship – citizenship of Ukraine. However, such a strange reaction of the ENG crew to this situation surprises, since many of our citizens and families of Ukrainian officials have recently moved to a permanent residence abroad. But when it comes to them, the media tend to protect their desire to leave the country and to blame the government that cannot create the proper conditions for life in Ukraine. In the situation with Oleksiy Vadaturskyy, despite the fact that he does not even plan to move anywhere, they are trying to put it almost as a crime. Oleksiy Vadaturskyy, as well as every citizen of Ukraine who is engaged in economic activities in Switzerland, has the appropriate permits to stay in this country to conduct business operations without any obstacles. These documents are renewed each year in accordance with the legislation of the country. Thus, the state, in this case Switzerland, creates proper conditions for foreign citizens who have legal business there. In addition, with the reputation of a respectable citizen and businessman, Oleksiy Vadaturskyy has long-term visas to other countries of the world.
By the way, the Swedish Embassy has called us recently asking whether we have problems. At first, we could not understand the reason for such questions. However, later on it became clear that journalists in their program talked about Switzerland, and the pictures were from the site of the Swedish Migration Agency.
Despite the free access of the General Director of the company to the territory of the leading foreign countries, our company actively promotes Ukraine to foreign guests, presenting our best achievements, thereby increasing the investment potential of Ukraine. After all, NIBULON’s employees, like the entire family of Oleksiy Vadaturskyy, are patriots.
In addition, our company, without any grounds, was accused of hampering draft laws and river development. But for some reason they “forgot” to recall that according to the professional rating Oleksiy Vadaturskyy was recognized as a “Person of the Year 2017 on Water Transport”  “for the systematic development of river transportation and shipbuilding in Ukraine”; for “attracting large investments in the economy of Ukraine”; for “defending the interests of Mykolaiv region in the central executive authorities in terms of  liberalizing the navigation rules along the Buh-Dnipro-Lyman Canal, dredging of the Buh-Dnipro-Lyman Canal and the Southern Buh River”, etc.This victory is also valuable due to the fact that for the first time since the independence of Ukraine, a person from the agricultural sector of Ukraine received this title. The winners were determined by a group of 70 professionals from the maritime complex. At the same time, people who constantly appear on TV screens and in this program, who claim to be professionals, reformers and corruption-fighters, took the first place among the failures of 2017 for Ukrainian water transport. In particular, experts described their work as “the dominance of incompetent people in the leadership of the Ministry of Infrastructure of Ukraine”, “appointment of “political” non-core specialists to the management of state enterprises of the maritime complex”, etc. Experts also noted “the emergence of new corrupt schemes in ports involving unreliable companies”, “the return of the institute of “beholders”, etc.
The journalists could not but mention the “sensational” story with David Clark, the former head of Nibulon S.A., who was in Panama Papers. In fact, for David Clark, this story ended 30 years ago, i. e. 18 years before Nibulon S.A. was established in Switzerland. By the way, he did not do anything unlawful. But, as soon as we learned about this situation, we fired him immediately, without unnecessary delays and coercion in order to avoid any reputational risks. And here we have a question, for journalists who have shown interest in the situation with David Clark as well: “Have you been so enthusiastic about Ukrainian officials who appear in the same Panamagate, and who of them at his own will has left his post without coercion?” The answer in Ukrainian environment is obvious.  
So when journalists tried to get to a private residence in Switzerland in search of the head of the Swiss company, they should not have spent money on a trip to Switzerland. One could just visit our shipbuilding and repair yard in Mykolaiv on May 23, where the international shipbuilding exhibition with the participation of the President of Ukraine took place, and to communicate with the head of the Swiss company Oleksiy Vadaturskyy, who at that time welcomed the President in Mykolaiv. Andriy Vadaturskyy informed the journalists about this in a text message, but they replied that they would be on a business trip. Later on, it turned out that they were hunting for David Clark and tried to interfere in private life of a Swiss citizen who has nothing to do with NIBULON. Therefore, they were politely asked to come out.
Given the almost twenty-seven year experience of various attacks, both information and raider attacks, we hoped to see the history of the Churkin brothers in the list of “accusations” and accusations of collapse of Ukrainian shipbuilding, other fictional stories of the 90’s. Apparently, this portion of fake information will be in the following programs. When the time comes, Oleksiy Vadaturskyy will pay attention to these fakes in his memoirs.
In general, we are disappointed with the low professional level of the program’s journalists and so-called experts who commented on the company’s activities based on gossips, and have presented themselves as experts in the financial and agricultural sectors of the economy. It is not surprising. Because the professional level of the people who ordered this program, whose names we of course know, is also low. As a result, Channel 5 broadcast a low-level and non-professional program. We advise customers to spend more money next time and hire more professional journalists and experts – we will be more interested in discussion in the information space and we are ready for open communication on the air in the form of e.g. a round table, rather than gossips and misrepresentation.
What can we talk about with journalists who ask questions like “Why does NIBULON refuse to pay the river dues?”, if one only speaks about them, and de jure there are no such dues and they did not exist before. We would advise the customers to read about these issues, and the executors to gain insight on the issues.
Such incompetence of journalists, fighters against corruption who do not refrain from making paid and false programs, are hardly can help to fight real corruption, but will contribute to its flourishing among officials and dishonest businessmen. Moreover, due to such journalists, public confidence in the media is undermined, and the image of Ukraine in the world is unlikely to benefit from this. Consequently, every Ukrainian will lose.
We have already sent our official request to Channel 5 asking to provide information about a person, company, member of the ENG crew who is/are executor/-s (author, developer or producer) of the information product. We are waiting for full information from the channel. Upon receiving a reply to this request, we will decide on our further actions in this situation. 
We would like media to pay attention to the fact that in case of distribution of false information revealed in the program “Stop Corruption”: “NIBULON’s Credit Secrets”, we will defend honor, dignity and business reputation of NIBULON and its owners in a court.

This information attack on the background of the company’s success in implementing its large-scale investment project, within which we construct terminals, fleet, and our financial successes, aims to underestimate the importance of these events for the national economy of Ukraine. It is also another attempt to pass an anti-state draft law “On Inland Water Transport” in the Verkhovna Rada. Oleksiy Vadaturskyy informed the President of Ukraine about this, so that it would be possible to study this issue in detail and professionally. This issue has more than ten-year history. If it is solved, Ukraine will be capable of reviving river transport taking into account the world experience.
Ordering such materials against us, officials do not even understand the significance of NIBULON for Ukraine and for its development. For Ukraine, NIBULON S.A. is a connection with the world economy and the world financial structure. Thanks to our company and Nibulon S.A., Ukraine is developing at the European level. And we did not buy yachts, planes, etc. abroad. But we have invested about USD 2 billion in Ukraine.
The leading international financial institutions trust us. Ambassadors respect the investment activities of our company and always attend our solemn events. Moreover, On August 1, 2017, during the solemnities on the occasion of Swiss National Day in Kyiv Guillaume Scheurer said that it was true honor to give the William Tell Award to Hero of Ukraine Oleksiy Vadaturskyy on behalf of the Embassy of Switzerland in Ukraine and Moldova for the fact that he has made considerable contribution to Ukraine and has strengthened relations between Ukraine and Switzerland.
We thank the embassies of different countries, whose leaders have visited our facilities, who support us, realizing that the activities of our company is the movement of Ukraine ahead. In the history of our company there were difficult periods, threats of illegal takeovers, but the Embassies of the USA, France and Denmark defended our independence.
The European countries are countries where people live happily. And our company does everything in order Ukrainians could live better. Therefore, it is strange that other countries help and support us, and our ministers hamper the development of the company. The today’s problem is in people who rein us.
However, despite all this information mud, our partners, whom we constantly inform about the course of events, have trusted us and continue to do so. Such trust has been formed over many years, including the difficult periods of Ukraine formation as an independent state. And in the future, we will continue our cooperation. We cannot be stopped. And we will implement our investment programs not only in Ukraine but also abroad.
